378) of Land and Premisses herein before mentioned by Such Names Numbers of Acres Quantities Qualities Terms and Discriptions in the said Writ to be Contained and in Such Manner and form as by Council Learned in the Law shall be Advised unto and upon which Writ of Entry so to be prosecuted and sued forth the said William Hayward Shall Appear gratis and Vouch to Warranty the said William Taylor and Arthur Mack Allen which said William Taylor and Arthur Mackallan shall also Appear gratis either in Person or by their Attorneys lawfully Authorized and Enter into Warranty and after their Entry in Warranty Shall Vouch to Warranty the Common Vouchee who shall likewise appear and Imparle and afterwards make Default and depart in Contempt ^to^ of the Court so that Judgment may be thereupon had and given for the said Littleton Dennis to recover the Said One hundred Acres of Land bounded and lying as aforesaid with the Appurtenances against the said William Hayward and for the said William Hayward to recover in Value against the said William Taylor and Arthur Mackallan and for the said William Taylor and Arthur Mackallan to recover in Value against the Common Vouchee to the End one perfect Common Recovery with double Voucher may be thereupon had and Suffered and all and every other thing and things be done and perfected needfull and Convenient for the having and Suffering the Same Recovery according to the Course ^of^ common Recoveries in such cases used and the same Recovery is also to be Executed by one Writ of Habere facias Seisinan accordingly and it is hereby Covenanted agreed and declared by and between the said parties to these presents that Such Recovery or Recoveries so as aforesaid or any other Manner to be Suffered Executed and perfected whereto the (parties) |
