312) Ex.d This Indenture made this Twenty fifth day of September in the Year of our Lord Seventeen hundred and fifty Eight Between Samuel Smith of Patapsco Neck in Baltimore County Planter and Elizabeth his Wife of the one Part and Joseph Ensor of Cecil County Gentleman of the other Part Whereas at a Provincial Court held at the City of Annapolis the Second Tuesday of September Instant the aforesaid Joseph Ensor by a Writ of Entry Sur Disseisin en le Post did Demand against the aforesaid Samuel Smith and Elizabeth his Wife all that Tract or Parcel of Land called East Humphrys lying and being in Baltimore County aforesaid on the East Side of Chesapeak Bay on the North Side of a River called Patapscoe River and on the West Side of a Creek called Clapers Creek containing three hundred Acres with the Appurtenances unto and upon which Said Writ of Entry the aforesaid Samuel Smith and Elizabeth his Wife did appear and did Vouch to Warranty thereof the Common Vouchee who forthwith appeared and did enter into the Warranty of the Same and afterwards made default whereby a Common Recovery of the Premisses with the Appurtenances was had and perfected as by the Record thereof in the Said Provincial Court remaining may more at Large appear Now this Indenture Witnesseth that is is Covenanted granted and Agreed upon by and between the said Parties to these Presents and the Said Samuel Smith and Elizabeth his Wife for themselves and each of them their and each of their Heirs Executors and Administrators Do hereby covenant grant and agree to and with the Said Joseph Ensor his Heirs Executors Administrators and Assigns and do also hereby signify and declare that the true Intent and Meaning of the said (Samuel) |
