       Mentioned, and that they the Same Edward Barnes and James
       Catherall subscribed their Names as Witnesses thereto before me one
       of his Lordships Justices of the Provincial Court of the Province
       of Maryland this 17.th Day of August Anno Domini 1757

Ex.d      This Indenture made this twentieth Day of March in
       the year of our Lord One thousand Seven hundred and fifty Seven
       Between John Gardner of Queen Anns County Planter of the one
       Part and Christopher Dukes of Baltimore County ^Planter^ of the other
       Part Witnesseth that for and in Consideration of the Sum of Twenty
       One pounds ten shillings Current Money by the said Christopher
       Dukes to the said John Gardner in Hand paid before the Sealing
       and Delivery of these Presents the Receipt whereof is hereby
       Acknowledged it is covenanted concluded and agreed between
       the Parties to these presents for them and their Heirs that it
       shall and may be lawfull for the said Christopher Dukes
       before the last Day of the next Provincial Court to procurate
       out of the High Court of Chancery one or more Writ or Writs
       of Entry Sur disseizin in the Post against the said John
       Gardner returnable to the next Provincial court whereby
       the said Christopher Dukes shall and may demand against the
       Said John Gardner one undivided moiety of all that Tract or
       Parcell of plantable Land Lying and being in Baltimore
       County aforesaid called Cherry Garden containing in the
       whole one Hundred Acres with the Appurtenances by such
       name or names Quantity or Quantities Quality or Qualities
       Content or Number of Acres as shall be thought fit and
       requisite to which Writ or Writs the said John Gardner shall
       appear in Proper Person and shall vouch over to Warranty
       the Common Vouchee and the Common Vouchee shall
       appear and imparle and afterwards shall make Default
