9) then North fifty six Degrees East twenty Perches then South One Hundred and twenty Perches then West Sixty Perches then South One Hundred and thirty Perches then with a Streight Line to the Beginning Tree Containing One hundred and fifty one and an half Acres of Land more or less together with all Rights Profits Benefits Privileges Improvements and Appurtenances thereunto belonging or any ways Appertaining To have and to hold the afs.d Tract of Land with all and Singular the Appurtenances unto him the said James Perkins his Heirs and Assigns for Ever to his only proper use and behoof and to no other Intent or purpose whatsoever And the said Samuel Hart and Catherine his Wife and Elizabeth Gardner and their Heirs the afs.d Tract of Land and Premisses hereby Granted or mentioned or intended to be Granted with all the Appurtenances unto the said James Perkins his Heirs and Assigns against them the said Samuel Hart and Catherine his Wife and Elizabeth Gardner their Heirs and Assigns and against all and every other person and Persons Claiming by from or under them or either of them shall and will Warrant and for Ever Defend by these Presents In Witness whereof the said Parties to these Presents have hereunto set their Hands and Seals the Day and Year above written Sealed and Delivered Sam.l Hart Seal in the Presence of Us Cath Hart Seal Darby Lux W Worthington jun.r Eliz.a Gardner Seal On the Back of the aforegoing Deed was thus Endorsed Viz.t Maryland Baltimore County fs Sep.r 11.th 1749 Then came before Us the Subscribers two of his Lordships Justices of Baltimore County Court the within named Samuel Hart and Catherine his Wife and Elizabeth Gardner Parties to the within Deed and acknowledged the within Deed to be their Act and Deed and the Land therein mentioned to be the Right and Property of the within mentioned James Perkins his Heirs and Assigns for Ever according to the purport of the within Deed and true intent and meaning thereof and the Act of Assembly in such case made And at the same time Catherine Hart the Wife of the said Samuel and one of the Parties to this Deed who being privately Examined by us out of the Hearing of her said Husband declared that she Willingly and freely (without being induced thereto by fears or threats or ill Usage by her said husband or fear of his Displeasure) acquitted and Released all the Right and Claim of Dower she hath in or to the within mentioned and Bargained Premisses according to the Act of Assembly afs.d taken and acknowledged the day and Year above before us Darby Lux W Worthington jun.r Sep.r 11.th 1749 Then Received of James Perkins the Sum of twenty five Pounds Sterling being the Consideration mentioned in the within Deed By us Witnesses Sam.l Hart Darby Lux Cath Hart W Worthington jun.r Eliz.a Gardner Reced of M.r James Perkins Six Shillings and one Penny Sterling for his Lordships use 8 (it being the Alienation fine on the within mentioned One hundred fifty One Acres and an half Acre of Land) By Virtue of a Commission from Benjamin Tasker Esq.r his said Lordships Agent and Receiver General Rich.d Dorsey Recorded November 6.th 1749 Vide Certificate hereafter Recorded in this Book fol 47 |
