639 Person or persons from by & under him shall and will Warrant and forever defend and the said John Forrest Davis doth for himself and his heirs Executors and Administrators Covenant Promise Grant and Agree to and with the said Thomas Davis his heirs and Assigns that he the said Thomas Davis his heirs and assigns shall and may Quietly hold Occupy and Possess the Aforesaid Bargained Land and Premisses with the Appurtenances free from any sute or Interruption of any Person or Persons from by and under him and that the said Land and Premisses with the Appurtenances shall forever Remain and Continue unto the said Thomas Davis his heirs and Assigns forever Clearly Acquitted and Discharged from all former Bargains Grants Dowers Rents Arrearages of Rents and all other Incumbrances whatsoever and Lastly it is Agreed by and between the said Parties to these Presents that every the Assureances so as aforesaid made shall be and shall be always taken to be the only Proper Use and Behoof of him the said Thomas Davis his heirs and Assigns forever and to no Other Use Intent or Purpose whatsoever any thing herein Contained to the Contrary Notwithstanding In Witness whereof the Party to these Presents first above Named hath hereunto set his hand and affixed his Seal this day and year first above Written John Forrest Davis Seal Signed Sealed and delivered in Presence of Edward Burges John Quirk On the Back of the foregoing Deed was thus Written to Wit January 20.th 1756 Then Came before us the subscribers two of his Lordships Justices of the Peace for Frederick County the within Named John Forrest Davis and Acknowledged the within Bargained Land and Premisses to be the Right and Estate of the within Named Thomas Davis his heirs and Assigns forever And at the same time came Cattran Davis the Wife of the Above John Forrest Davis and Acknowledged her Right of Dowrey to the within Land and Premisses to be the Right of the within Named Thomas Davis his heirs and Assigns forever and Declared that she did it freely and Willingly without being Compelled by her Husband by Threats or Abuse after being Privately Examined out of her Husbands hearing David Lynn John Smith Prather January 20.th 1756 Received Ten Pounds fifteen Shillings Currency of Maryland it being in full Consideration for the within land and Premisses as Witness my hand Test David Lynn John Forrest Davis John Smith Prather January 21.st 1756 Received of M.r Thomas Davis Two Shillings Sterling for his Lordships use (it being the alienation fine on the within Mentioned Fifty Acres of Land) by Virtue of a Commission from Edward Lloyd Esq.r his said Lordships Agent and Receiver General 6 sides Recorded Rich.d Dorsey |
