635 Acres of Land more or Less with all and Singular the Premisses and Appurtenances thereunto Belonging To have and to hold the aforesaid four Hundred and Eight Acres of Land and every Part and Parcell thereof Together with all and Singular the Premisses and Appurtenances thereunto belonging unto him the said Thomas Davis his heirs and Assigns unto the only proper use and behoof of the said Thomas Davis his heirs and Assigns forever And the said Samuel Davis son of John and his heirs the said four Hundred Eight Acres of Land and every part and Parcell thereof unto the said Thomas Davis and his heirs in Manner and form aforesaid Convey'd against him the said Samuel Davis son of John against all and Every Person and Persons from by and Under him shall and will Warrant and forever defend and the said Samuel Davis son of John Doth for himself and his heirs Executors and Administrators Covenant Promise Grant and Agree to and with the said Thomas Davis his heirs and assigns that the said Thomas Davis his heirs and Assigns shall and may Quietly hold Occupy and Possess the aforesaid Bargained Land and Premisses with the Appurtenances shall forever Remain and Continue unto the said Thomas Davis his heirs and Assigns Clearly Acquitted and Discharged from all former Bargains Grants and all other Incumbrances whatsoever and Lastly it is Agreed by and between the Parties to these Presents that every the Assureances so as aforesaid made shall be and shall be always taken to be the only proper use and behoof of him the said Thomas Davis his heirs and Assigns forever and to no other use Intent or Purpose whatsoever any thing herein Contained to the Contrary Notwithstanding In Witness whereof the Party to these Presents first above Named hath hereunto set his hand and Affixed his Seal the day and year first above Written Sam.l Davis son of John Seal On the back of the aforegoing was thus Written to Witty Signed sealed and delivered in Presence of Henry Howard Ephraim Howard December 13.th 1755 Then Received of Thomas Davis the Sum of Forty Pounds Currency it being in full Satisfaction for the within mentioned Land as Witness my hand Test Henry Howard Sam.l Davis son of John December 13.th 1755 Then Came before us the Subscribers two of his Lordships Justices of the Peace for Ann Arundell County ^that^ the within named Sam.l Davis son of John did Acknowledge the within Bargained Land and Premisses to be the Right and Estate of the within Named Thomas Davis his heirs and Assigns forever Henry Howard Ephraim Howard December 16.th 1755 Rec.d of M.r Thomas Davis sixteen shillings and four pence sterling for his Lordships use (it being the alienation fine on the within mentioned four hundred and Eight Acres of Land) by Virtue of a Commission from Edward Lloyd Esq.r his said Lordships Agent and Receiver General Rich.d Dorsey 6 1/2 sides Recorded |
