619 This Indenture made the Twentieth day of September in the Year of our Lord one thousand seven hundred and fifty five Between Thomas Johnson Junior of Ann Arundell County Gentleman of the one Part and Caleb Dorsey of the same County Gentleman of the Other Part Witnesseth that it is Covenanted Concluded and agreed between the Parties to these Presents that it shall and may be Lawfull for the said Thomas Johnson Junior before the first day of the next Provincial Court to Purchase out of the High Court of Chancery one or more Writt or Writts of Entry Sur Deseizin in the Post against the said Caleb Dorsey Returnable to the next Provincial Court whereby the said Thomas Johnson Junior shall and may demand against the said Caleb Dorsey one Undivided moiety of all that Tract or Parcell of Plantable Land called Chews Resolution Mannor with the Appurtenances in Ann Arundel County containing in the whole thirteen hundred and eighteen acres, And also one Undivided Moiety of all that Tract or Parcell of Plantable Land called Chews Vineyard with the Appurtenances in Ann Arundell County aforesaid containing in the whole One Thousand and twenty four Acres and also one Undivided Moiety of two hundred Acres of Plantable Land with the appurtenances in Ann Arundell County aforesaid being part of a Tract or Parcell of Land called the Long Reach And also one Undivided moiety of all that Tract or Parcell of Plantable Land called the Gore with the Appurtenances Containing in the whole one hundred and thirty five acres by such Name or Names Quantity or Quantities Qualitie or Qualities content or Number of Acres as shall be thought fit and Requisite to which said Writt or Writts the said Caleb Dorsey shall appear in Proper Person and shall Vouch over to Warrantee the Common Vouchee and the Common Vouchee shall Appear and Imparle and afterwards make default whereby one or more Recovery or Recoveries Judgement or Judgements may be had & given for the said Thomas Johnson Junior for Recovery of the said Lands and Premisses against the said Caleb Dorsey and for the said Caleb Dorsey to Recover over in Value against the Common Vouchee according to the form of Common Recoveries in such Cases used and it is further covenanted granted and agreed by and between the Parties to these Presents and the true intent and meaning |
