494) To have and to hold the said Land and Premisses herein before mentioned and Intended to be hereby Granted with their and every of their Appurtenances unto the said Edward Lloyd his heirs and Assigns for ever to the only Proper used and behoof of ^him^ the said Edward Lloyd his heirs and Assigns and the said John Dagworthy the ^said^ Tract or Parcell of Land with their and every of their Appurtenances and Premisses aforesaid unto him the said Edward Lloyd his heirs Executors Administrators and Assigns against all Persons whatsoever shall and will Warrant and Defend by these Presents Provided always and these Presents are upon this Condition Nevertheless that if the said John Dagworthy his Executors or Administrators shall well and Truly pay or cause to be paid to the said Edward Lloyd his Executors Administrators or assigns the afsd Principal Sum of Money in the said in Part Recited Bond mentioned with Legal for the same from the said date of ^the^ said Bond to be paid Yearly and Every Year as it arises due together with the Charge of Drawing and Recording this Conveyance then this Present Indenture and the Estate hereby made shall Cease and Determine and the Lands and Premisses become the Right and Estate of the said John Dagworthy and his heirs any thing herein Contained to the Contrary in any wise Notwithstanding In Witness whereof the Parties to these Presents have hereunto Interchangeably set their hands and Seals the day and year first above Written Sealed and Delivered Jn.o Dagworthy seal in the Presence of E Dorsey On the Back of the aforegoing Mortgage was thus Hy Woodward Indorsed (Viz.t) Rec.d September the Twenty eighth 1754 of Edward Lloyd Esq.r One shilling Sterling being the Consideration Money within mentioned Witness Jn.o Dagworthy E Dorsey Then came before me the Subscriber one of his Lordships Justices of the Provincial Court the within named John Dagworthy and acknowledged the the within Right and Estate of the said Edward Lloyd and his Heirs According to the Directions of the Act of Assembly in that case made and Provided Acknowledged before me this 28.t day of September 1754 Jn.o Brice The within named John Dagworthy being duly Sworn deposeth and saith that the within Land called Bashon with the Appurtenances are absolutely Free and Clear from any Incumbrance made by the said John Dagworthy or any other person or Persons by his means or Procurement Sworn to before me September the 28.th 1754 6 3/4 Jn.o Brice Recorded Sept.r 28.th 1754 |
