478) the better enabling the said Lancelot Jacques to ask demand recover and receive the said Debt and Debts Sum and Sums of Money and Premisses hereby granted bargained sold and assigned he the said Peter Fearon hath made ordained constituted authorized and appointed and by these Presents doth make ordain constitute authorize and appoint the said Lancelot Jacques his Executors Administrators and Assigns his true and lawful Attorneys irrevocable in the Name of him the said Peter Fearon or as Administrator of the said John Fearon (deceased) but to the only proper Use and Behoof of him the said Lancelot Jacques his Executors Administrators and Assigns to ask demand levy sue for recover and receive of and from all or any Person or Persons whatsoever whom it shall or may concern inhabiting or being in the Province of Maryland aforesaid all such Debt and Debts Sum and Sums of Money Negroes Cattel Tobacco Goods Merchandize or Effects whatsoever now due owing payable belonging or in any wise appertaining unto him the said Peter Fearon or to the Estate of the said John Fearon deceased and hereby granted bargained sold and assigned meant or intended so to be and every Part and Parcel thereof hereby giving and granting unto his said Attorney and Attorneys full Power and Authority in and about the Premisses for recovering compounding or releasing the same as he or they shall think fit But in case of Refusal or Delay by all or any Person or Persons concerned to make and render just & true Account Payment Delivery and Satisfaction in the Premisses him her them or any of them thereunto to compel by all lawful Ways and Means whatsoever and one or more Attorneys under him or them to substitute and appoint and the same again to Revoke at his or their free Wills and Pleasure and to do and execute all other Acts Matters and Things for the recovering receiving compounding or releasing the Premisses as fully and effectually as he the said Peter Fearon might or could do if personally present he hereby ratifying and confirming all and whatsoever his said Attorney or Attorneys his or their Substitutes or Assigns shall lawfully do or cause to be done in or about the Premisses by Virtue of these Presents And the said Peter Fearon doth hereby for himself his Executors and Administrators Covenant Promise and Grant to and with the said Lancelot Jacques his Executors Administrators and Assigns by these Presents That neither he the said Peter Fearon his Executors or Administrators shall or will at any Time or Times hereafter receive or acquit release or discharge all such Debt or Debts Sum or Sums of Money or Premisses hereby bargained sold and assigned or any Part or Parcel thereof without the Consent of him the said Lancelot Jacques his Executors Administrators or Assigns first had and obtained in Writing under his or their Hands for that Purpose And shall and will Justify all such lawful Actions & Proceedings either in Law or Equity as shall be brought prosecuted or defended concerning (the) |
