426) whatsoever and the said Joseph Bickerton for himself his heirs Ex.rs and Administrators doth further Covenant grant and agree to and with the said John Skinner his Heirs and Assigns that he the said Joseph Bickerton the afs.d three parcells of Lands with their and every of their Appurtenances against the lawfull Claim of all Persons whatsoever to him the said John Skinner his heirs and assigns will for ever Warrant and Defend by these Presents Provided Nevertheless and it is the true Intent and meaning of these Presents that in case the afs.d Joseph Bickerton his Heirs Ex.rs or Administrators do and shall well and truly Pay or Cause to be Paid to the afs.d John Skinner his Heirs Ex.rs Adm.rs or assigns the before mentioned sum of sixty Pounds Current money at or before the Twenty Seventh day of September which shall happen in the year of our Lord one Thousand seven Hundred and fifty five being two years from the date hereof with Lawfull Interest for the same that then this Present Indenture of Bargain and sale to be utterly void and of none Effect as if the same never had been made otherwise to stand and remain in full force and virtue in Law In Witness whereof the said Joseph Bickerton hath hereunto sett his hand and affixed his seale the Day & year first above written Sealed & Delivered Joseph Bickerton seal in Presence of One the Back of the aforegoing Deed was thus Indorse (Viz.t) Thomas Ireland Jun.r Calvert County fs.t It is to be Remembered that on the David Arnold day and year within written the within named Joseph Bickerton Personally appeared before us the Subscribers two of the right Honb.le the Lord Proprys Justices of the Peace for the County afs.d and acknowledged the within written Indenture to be his Act and Deed for the uses within mentioned and prayed the same may be recorded where the same by Law ought In Testimony whereof hereunto ^we have^ Subscribed our handes the date within written Thomas Ireland Jun David Arnold Rec.d Sept.r 27.th 1753 of M.r John Skinner Sixty Pounds Current money being the Consideration money within mentioned I sat Rec.d P.r Joseph Bickerton Test David Arnold Calvert County to wit In Testimony whereof that the Worshipfull Thomas Ireland Jun.r and David Arnold Gentleman who have Subscribed their names to the Seal of County above acknowledgement at the time of there so doing now and still are Court two of the Right Honble the Lord Proprietarys Justices of the Peace for the 7 sides County afs.d thereunto Lawfully assign.d &c The Seale of the same County Court is hereto affix.d this 2.d day of Oct.r Anno Dom 1753 Recorded Oct.r 16.th 1753 P.r Will.m Ireland Clerk Court |
