349) of Writing to be their several Act and Deed to and for the Uses within mentioned respectively, then Came also before me the Subscriber within named Agnes Lux Wife of the said William Lux and being by me Examined out of the hearing of her said Husband did Acknowledge the within Instrument of Writing to be her Act and Deed according to the true Intent and meaning thereof and she did then also declare that she Executed the same and thereby Released and Conveyed her Right to and Estate in the within mentioned Lands and Appurtenances to the Uses and Purposes within mentioned Voluntarily and freely and of her own Accord without any Threats or other Compulsory means from her said Husband or fear of his Displeasure Jn.o Brice 14 April 1753 Received for the Use of the Right Honourable the Lord Baltimore forty two Shillings and three Pence Sterling being for the Alienation Fine of the within 1057 Acres as also one Penny Sterling for the Alienation Fine of one Lott of Acre of Land Benj.a Tasker M.r Burdus Record this Lease & Release in the Provincial Land Records for safe keeping Y.rs 7 1/2 B Nicholson Recorded April 13.th 1753 Ex.d This Indenture made the ^twenty^ third day of March in the Year of our Lord Seventeen hundred and fifty three Between Thomas Coode of Saint Marys County Gentleman of the one part and Edward Smoote of Charles County Gentleman of the other part Witnesseth that the said Thomas Coode for and in Consideration of the Sum of five Shillings Current Money by the said Edward Smoote to him in hand paid at or before the Sealing and Delivery of these Presents the Receipt whereof he doth hereby Acknowledge and thereof and therefrom and of and from every part thereof doth hereby Release Acquit and Discharge the said Edward Smoote his Executors and Administrators Hath Granted Bargained and Sold and by these Presents Doth grant bargain and sell unto the said Edward Smoote his Executors Administrators and Assigns All that Tract or Parcel of Land called Penrin situate lying and being in Saint Marys County aforesaid Surveyed for One hundred and ninety two Acres which is now ^is^ or lately was in the Tenure or Occupation of the said Thomas Coode with all and singular the Appurtenances thereunto belonging or in any wise Appurtaining and the Reversion and Reversions Remainder and Remainders Rents Issues and Profits thereof and every part thereof To have and to hold the said Land and Premisses with the Appurtenances unto the said Edward Smoote his Heirs Executors Administrators and Assigns from the day next before the day of the date of these Presents for and during and untill the full end and Term of one whole Year from thence next ensuing and fully to be Compleat and ended to the Intent and Purpose that the said Edward Smoote may be in the Actual Possession of the said hereby Bargained and Sold Land and Premisses with the Appurtenances and may hereby and by force ^and Virtue^ of the Statute for Transferring Uses into Possession in that behalf made and Provided be enabled to take a Grant and Release of the Revertion and Inheritance of the said Lands and Premisses hereby Bargained and Sold or intended (so) |
