350) so to be with the Appurtenances to him and his Heirs to such Uses and Purposes as shall be thereby declared In Witness whereof the said Parties to these Presents have hereunto Interchangeably set their hands and Seals day and Year above written Signed Sealed and Delivered Tho.s Coode Seal in the Presence of Us Edward Smoot Seal Ja.s Barrance S Bordley jun Recorded April 17.th 1753 4 Ex.d This Indenture Tripartite made the twenty fourth day of March in the Year of the Lord Seventeen hundred and fifty three Between Thomas Coode of Saint Marys County Gentleman of the first part Stephen Chandler of Charles County Gentleman of the Second part and Edward Smoote of the same place Gentleman of the third part Witnesseth that for and in Consideration of the Sum of Ten Shillings Current Money to him the said Thomas Coode in hand paid by the said Edward Smoote at or before the Sealing & Delivery of these Presents the Receipt whereof the said Thomas Coode doth hereby Acknowledge and ^thereof and^ therefrom and of and from every part and parcel thereof doth hereby Release Acquit and Discharge the said Edward Smoote his Heirs Executors & Administrators And for the Docking barring and Extinguishing all Estates Taile and all Revertions and Remainders thereupon expectant or depending of and in the Lands Tenements and Hereditaments herein after mentioned he the said Thomas Coode (by and with the Advice and Consent of the said Stephen Chandler Testifyed by his being a Party to and his Sealing and Executing these Presents) Hath granted bargained sold Aliened released and confirmed and by these Presents Doth grant bargain sell Alien Release and Confirm unto the said Edward Smoote (In the Actual Possession of the Lands and Premisses herein after mentioned now being by Virtue of a Bargain and Sale to him thereof made by the said Thomas Coode for the Consideration of the Sum of five Shillings Current Money by Indenture bearing date the day next before the day of the date of these Presents for the Term of one whole Year commencing from the day next before the day of the date thereof and by force of the Statute for Transferring Uses into Possession) All that Tract or Parcel of Land called Penrin Situate lying and being in Saint Marys County aforesaid Surveyed for One hundred and ninety two Acres which now is or lately was in the Tenure and Occupation of the aforesaid Thomas Coode And all Edifices and Buildings ways Waters Water Courses Easments Profits Commodities Advantages Improvements and Appurtenances whatsoever to the said Tract or Parcel of Land hereby Released or mentioned or intended so to be belonging or in any wise Appurtaining or to or with the said Tract or Parcel of Land had Used Occupied & Enjoyed (And) |
