344) Acknowledge Hath Given Granted Bargained Sold Aliened Enfeoffed and Confirmed & by these Presents Doth Give Grant Bargain Sell Alien Enfeoff and Confirm unto him the said John Brice his Heirs and Assigns for ever All those two Tracts or Parcels of Land lying in Baltimore and Ann Arundel Countys the one called Edwards's Hopewell Containing Twenty one Acres of Land which was afterwards Resurveyed and called Edwards's Discovery Containing three hundred and fifty Acres of Land more or less and the other Tract of Land lying in Ann Arundel County called Edwards Lott containing fifty Acres of Land more or less, also a Servant Man named Samuel Sewal having near four Years to serve, a Dutch Man named William Sloverish his Wife named Magdalen and Son named George Sloverish also thirteen head of Black Cattle marked with a Crop & Staple Fork in the Right Ear & Crop & two Slits in the left Ear To have and to hold the afsd several Tracts or Parcels of Land and Premisses with their and every of their Appurtenances also the Servants and Cattle aforesaid unto him the said John Brice his Heirs and Assigns forever to the only proper Use and behoof of him the said John Brice his Heirs and Assigns and to and for no other Use Intent or Purpose whatsoever And the said Philip Edwards for himself his Heirs Executors and Administrators hereby Covenants and Agrees to and with the said John Brice his Heirs and Assigns that he the said Philip Edwards and his Heirs Ex.rs & Adm.rs the afsd several Tracts or Parcels of Land and Premisses with their Appurtenances and also the afsd Servant Man named Samuel Sewel and the Dutch Servants afsd together with the afsd thirteen head of black Cattle and their Increase unto him the said John Brice his Heirs and Assigns ^for ever to the only proper Use & behoof of him the said John Brice his Heirs and Assigns^ shall and will for ever Warrant and Defend by these Presents Provided always and it is the true Intent and meaning of these Presents That if the said Philip Edwards his Heirs Exors or Adm.rs shall well and truly pay or cause to be paid unto the afsd John Brice his Heirs or Assigns the afsd several Sums of fifteen Pounds Sterling Twenty seven Pounds Current Money and one Thousand Pounds of Inspected Tobacco with legal Interest on the afsd Money and Tobacco at or upon the Tenth day of April which shall be in the Year of our Lord God One Thousand seven hundred & fifty five then the above Instrument of Writing to be Void else to be & remain in full force and Virtue in Law, And the afsd Philip Edwards for himself his Heirs Ex.rs and Adm.rs further Covenants and Agrees to and with the said John Brice his Heirs and Assigns that he the said Philip Edwards for his Heirs Ex.rs & Adm.rs the afsd several Sums of fifteen Pounds Sterl and twenty seven Pounds Current Money and One Thousand Pounds of Inspected Tobacco at the time above mentioned with legal Interest for the same together with the Charge of Drawing & Recording this Indenture unto him the said John Brice his Heirs and Assigns shall & will well and truly pay and Satisfy In Witness whereof the said Philip Edwards hath hereunto set his hand and Affixed his Seal the Day & Year above Written Sealed and Delivered Philip Edwards seal in the Presence of Benj Beall Walter Clarke On the back of the aforegoing Deed was thus Endorsed Viz.t (Reced) |
