332) Ordain Constitute and Appoint the aforesaid David Ross his heirs Executors and Administrators his true and Lawfull Attorney irrevocable and for the Proper use Benefit and Behoof of the aforesaid David Ross his heirs Executors Administrators and Assigns and at his and their own Proper Cost and Charge only to Ask demand sue for Recover and Receive of and from any Person or Persons Whatsoever all and every or any Part of the aforesaid Premisses hereby Granted Assigned or set over or meant mentioned or Intend so to be And the same to settle Compound or Discharge in such manner as he or they shall think proper And if the said David Ross his Executors Administrators or Assigns shall think fit to Appear in any Court of Law or Equity and there to give Bail or otherwise litigate the Justice of any Attachment or other Claim made by any Creditor or Pretended Creditor upon or against any of the aforesaid Premisses that it shall be Lawfull for him or them ^so to do and for the Purposes aforesaid or any of them to substitute under him or them^ one or more Attorney or Attorneys and them at Pleasure to revoke and to Appoint others in their stead and the said Andrew Scott doth hereby Give and Grant unto him the said David Ross his heirs Executors Administrators and Assigns his whole Power in and Concerning the Premisses And the said Andrew Scott doth hereby for himself his heirs Executors and Administrators Covenant Promise Grant and agree to and with the said David Ross his heirs Executors and Administrators and Assigns that he the said Andrew Scott shall not nor will at any time hereafter revoke Countermand or otherwise annull the Powers and Authorities hereby given or any of them or any Part of any of them to the said David Ross his heirs Executors Administrators or Assigns In Witness Whereof the Parties to these Presents have hereunto Interchangeably set their hands and seals the day and Year first above Written Sealed & Delivered In the Presence of Andr Scott seal David Ross seal Jn.o Brice Benj.a Beall On the Back of the aforegoing Mortgage was this Indorsed (Viz.t) Received ^on^ the day and year first within named of and from the within Named David Ross the sum of five shillings Current Money in full for the Consideration within mentioned to be by him paid to me Andr Scott Witnesses Jn.o Brice Benj.a Beall 29.th August 1752 Then Came the within Named Andrew Scott before me the subscriber one of his Lordships Justices of the Provincial Court and Acknowledged the within Writing to be his Act and Deed for the Uses within mentioned and that the Lands Goods Chattles and Effects within Mentioned to be bargained and sold or Assigned transferred or sett over are the Estate right and Property of the within named David Ross his heirs Executors Administrators and Assigns according to the true Intent and meaning of the within Deed Jn.o Brice Received of Doctor David Ross One shilling and two Pence sterling for his Lordships use (it being the Alienation fine on thirty Acres of the Land Mentioned in the within Deed Called Sewall's Releif) by Virtue of a Com.n from Benj.a Taker Esq.r his said Lordships Agent and Receiver Generall 22 sides Recorded December 26.th 1752 Rich.d Dorsey |
