321) October 6.th 1752 Then Came before Richard Tilghman Esq.r One of the Justices of the Provincial Court the within mentioned James Gilleland and Acknowledged the within Deed and the Lands and Premisses therein Bargained and Sold to be the Right and Estate of Charles Carroll his Heirs and Assigns for ever according to the Act in that Case made and Provided 7 R.d Tilghman Recorded Oct.r 6.th 1752 Ex.d This Indenture made the thirteenth day of October in the Year of our Lord God Seventeen hundred and fifty two Between Thomas Cockey of Baltimore County Gentleman of the one part and John Brice of the County of Ann Arundel Gent of the other part Witnesseth that the said Thomas Cockey for and in Consideration of the Sum of fifty five Pounds Current Money to him in hand paid by the said John Brice the Receipt whereof he the said Thomas Cockey doth hereby Acknowledge Hath Given Granted Bargained Sold Aliened Enfeoffed and Confirmed and by these Presents he the said Thomas Cockey doth Give Grant Bargain, Sell, Alien Enfeoff and Confirm unto him the said John Brice his Heirs and Assigns for ever All that Tract or Parcel of Land called Middle Neck lying in Ann Ar.l County on the North side of Severn River Beginning at a Bounded White Oak standing on the side of a Hill by the Branch of a Creek called Ferry Creek Bounded on the North by a line drawn North North West from the said Oak for Breadth fifty Perches to another marked White Oak on the West by a line drawn South South West from the said White Oak for length One hundred and sixty Perches to another markt White by another Branch on the South by a line drawn East South East from the last named White Oak fifty Perches to another marked White Oak by the middle Branch on the East by a line drawn North North East up the Branch unto the first marked White Oak Containing and laid out for fifty Acres of Land more or less, Also all that Tract or Parcel of Land called Underwoods Addition lying on a Branch of the said Ferry Creek on the North Bounds of the afsd Tract of Land called Middle Neck Containing Twenty two Acres & one half of an Acre of Land more or less now in the Tenure and Occupation of the said Thomas Cockey, as also all that part of a Tract of Land called the Landing ^lying^ on a Branch afs.d Ferry Creek now in the Tenure and Occupation of the said Thomas Cockey Originally laid out for One hundred Acres as by Grant from the Lord Propry to Thomas Underwood appears all which said Tracts or Parcels of Land became the Right of the afsd Thomas Cockey by Virtue of ^a Devise of^ the same from his Uncle Thomas Cockey deceased as by the Will of the said Thomas Cockey duly Proved and Recorded in the Commissarys Office appears together with the Houses Buildings and Improvements therein being or thereto and to every part and Parcel thereof belonging or in any wise appertaining Together with all Writings Papers Patents Deeds and Conveyances to the said several Tracts of Land belonging To have and to hold all and singular the afsd several Tracts parts or Parcels of Land and Premisses with their and each and every of their Appurtenances unto him the said John Brice his Heirs and Assigns for ever to his and their only proper Use and Behoof and to and for no other Use Intent or Purpose whatsoever And the said Tho.s Cockey for himself his Heirs Exors and Adm.rs Covenants and Agrees to and with the s.d John Brice his Heirs and Assigns that he the said Thomas Cockey and his Heirs Ex.rs & Adm.rs the afsd Several Tracts Pieces or Parcels of Land & Premisses with their and each and every of their Appurtenances unto him the said John Brice ^his Heirs and Assigns^ as well against him the said Thomas Cockey and his Heirs as against all and every other Person or Persons (Claiming) |
