313) And the said James Macdonald for himself his Heirs Executors and Administrators the said Tract or Parcel of Land and all & singular other the Premisses with their and every of their Appurtenances unto him the said Edward Dorsey his Heirs and Assigns against all Persons whatsoever shall and will Warrant and defend by these Presents Provided always and these Presents are upon this Condition Nevertheless that if the said James Macdonald his Executors or Administrators shall well and truly pay or Cause to be paid to he said Edward Dorsey his Executors Administrators or Assigns the said Sum of thirteen Pounds two Shillings Current Money on the twenty fifth day of August which shall be in the Year of our Lord One Thousand Seven hundred and fifty five with legal Interest for the same from the date hereof together with the Charges of drawing and Recording this Conveyance Then this present Indenture and the Estate hereby made shall Cease and Determine and the Lands and Premisses become the Right and Estate of the said James Macdonald and his Heirs any thing herein contained to the Contrary in any wise notwithstanding And the said James Macdonald for himself and his Heirs Executors and Administrators and every of them doth Covenant Grant and Agree to and with the said Edward Dorsey his Executors and Administrators by these Presents That he the said James Macdonald shall and will well and truly pay the said Sum of Thirteen Pounds two Shillings Current Money at the day of Payment aforesaid with legal Interest for the same from the date hereof according to the true Intent and meaning of these Presents In Witness whereof the Parties to these Presents have hereunto Interchangeably set their hands and Seals the day & Year first above Written his Sealed and Delivered James X Macdonald Seal In the Presence of mark Tho.s Johnson jun.r H Woodward On the Back of the aforegoing Mortg.a was thus Endorsed Viz.t October the third 1752 Received of Edward Dorsey the Sum of thirteen two Shillings being the Consideration Money within mentioned his Witness H Woodward James X Macdonald mark Came before me the Subscriber one of his Lordships Justices of the Provincial Court the within mentioned James Macdonald and Acknowledged the within Deed as his Act and Deed and the Lands and Premisses within mentioned to be the Right and Estate of the within mentioned Edward Dorsey according to the form of the Act of Assembly in that Case 6 1/2 made and Provided this 3.d Oct.r 1752 Acknowledged before Recorded Oct.r 3.d 1752 Rob.t Jenckins Henry Ex.d This Indenture made made this Second day of October One Thousand Seven hundred fifty and two By and Between Charles Carroll Esquire and Doctor Charles Carroll Executors of James Carroll deceased of the one part and Samuel Webb of Baltimore County Tanner of the other part Witnesseth that Whereas Michael Taylor formerly of Baltimore County aforesaid did by his Deed of Bargain and Sale duly Acknowledged and Recorded bearing date the sixth day of August One Thousand Seven hundred and twenty nine did amongst other Lands for the Consideration of One hundred and thirty Pounds Sterling Money of Great Britain in the said Deed set forth Sell Alien and Confirm unto them the said Charles Carroll and Charles Carroll as Executors as aforesaid two Tracts of Land one (called) |
