276) Samuel in Fee several Tracts of Land and Chattels mentioned and Specifyed in a Codicil to the said Will to be Sold so far forth as might be Needfull to discharge the Debts due from his Estate and the said Samuel the Son Dying also did by his last Will and Testament ordain & appoint the said Lands and Chattels to be Sold and Disposed of according to the directions and Intent of the said Will by his Executors whom he appointed to be his Wife and the said Philip Thomas And Whereas it appeared to the High Court of Chancery that there was due from the said Samuel Chew Sen.r to Samuel Hyde of London Merchant the Sum of Twelve Hundred and twenty nine Pounds two Shillings and five Pence Sterling Money which said Sum the said Court of Chancery did Order and Decree should be paid to the Agent of the Lord Baltimore by the said Philip Thomas as Administrator of the said Samuel Chew Sen.r and that the said Philip Thomas should have the Sole Power to make Sale and Disposition of the said Lands and Chattels Agreeable to the directions and Intent of the Will and Testament of the said Samuel Chew Sen.r Now the said Philip Thomas by Virtue of the Power above recited and in order towards the Payment of the said Debt having Published the Sale of the said Lands and Chattels in the Maryland Gazett and other ways hath for and in Consideration of the Sum of Two hundred and forty Pounds Sterling Money of Great Britain to him in hand paid or Secured to be paid by the said William Thornton the Receipt whereof the said Philip Thomas doth hereby Acknowledge and thereof doth hereby Exonerate Acquit and Discharge the said William Thornton his Executors and Administrators he the said Philip Thomas Hath Granted Bargained Sold Aliened and Confirmed and by these Presents Doth Grant Bargain and Sell Alien and Confirm unto the said William Thornton his Heirs and Assigns for Ever All that part of a Tract or Parcel of Land Scituate and being in Baltimore County in the Province aforesaid being part of a Tract of Land called Clegates Forrest Containing according to the Certificate of Resurvey thereof Thirteen hundred and Seven Acres Also one other Tract or Parcel of Land Situate and lying in the said County called Bonds Gratuity Containing four hundred Acres Also fifty Acres called Sanctley Together with all and singular the Houses Messuages Tenements Buildings and Improvements of what Nature or kind soever to the said Lands and Premisses above mentioned belonging or any wise appertaining And also the Reversion and Reversions Remainder and Remainders Rents and Services of the said Premisses and of every part thereof To have and to hold the said several Tracts or Parcels of Land and all and singular the Premisses above mentioned and every part and parcel thereof with the Appurtenances unto the said William Thornton his Heirs and Assigns to the only proper Use and Behoof of the said William Thornton his Heirs and Assigns for ever and to no other Use Intent or Purpose whatsoever to be held of the Chief Lord or Lords of the Fee or Fees thereof by Rents and Services thereof due and of Right Accustomed In Witness whereof the Partys to these Presents have hereunto Interchangeably set their hands and Seals the Year and Day abovesaid Signed Sealed and Delivered P Thomas Seal In Presence of John Darnall Geo Steuart (On) |
