262) called Shepherds Forrest and running Contiguous thereto according to the lines and Courses in the Original Patent thereof mentioned and expressed, and of for or Concerning All that other Tract or Parcel of Land Containing three hundred Acres of Land more or less being part of a Tract of Land in Queen Annes County afsd called Smiths Ferm heretofore by Deed Granted and Conveyed by Robert Smith to the afsd Edward Smith and by the same Edward his last Will and Testament Devised to the same Ann his Daughter And of for in or Concerning all that other Tract of Land lying and being in Queen Annes County afsd containing three hundred Acres of Land more or less called Winfield heretofore by a certain Renatus Smith by his last Will and Testament Devised to the same Anne with the Appurtenances unto the same herein before mentioned several Tracts and Parcels of Land belonging and for the settling and Assuring the same to & for the Uses Intent and Purposes herein and hereby after Limitted Expressed and mentioned and declared as for and in Consideration of the Sum of five Shillings Current Money of Maryland to the same John Rogers and Anne his Wife in hand already paid by the same Thomas Butler and Robert Campbell the Receipt whereof is hereby Acknowledged and for divers other good Causes and Considerations them the same John Rogers and Anne his Wife moving Have Granted Remised Released and Confirmed and by these Presents Do Grant Remise Release and Confirm unto the same Thomas Butler (in his Actual Possession now being by Virtue of a Bargain and Sale to him thereof made for one Year by Indenture bearing date the day next before the day of the date of these Presents and by Virtue of the Statute made for Transferring Uses into Possession) and to his Heirs and Assigns for ever all the afsd Northermost Moiety or half part of the afsd Tract of Land called Chesterfield with the Appurtenances and all the afsd undivided Moiety or half part of the afsd first abovementioned Tract of Land called Triangle with the Appurtenances and all the afsd undivided Moiety or half part of the above mentioned Tract of Land called Triangle Addition with the Appurtenances and all that other last mentioned or Parcel of Land called Triangle with the Appurtenances and all that undivided Moiety or half part of the Tract of Land called Shepherds Forrest first above mentioned with the Appurtenances and all that Moiety or half part being part of Shepherds Forrest afsd last above mentioned with the Appurtenances And all that Tract of Land aforesaid part of a Tract of Land called Smiths Ferm with the Appurtenances and all that other Tract of Land afsd called Winfield with the Appurtenances To have and to hold all and singular the aforesaid described mentioned and Granted Tracts and Parcels of Land with the Appurtenances to them and every of them belonging or Appertaining unto the same Thomas Butler his Heirs and Assigns for ever to the Intent and Purpose that he the same Thomas Butler ^may^ become a perfect Tenant of the Freehold of the same Granted Lands and Premisses whereby one or more Common Recovery or Recoverys shall and may be thereof had and suffered in manner and form hereafter following for which Intent and Purpose it is hereby Covenanted Concluded and Agreed upon by all the Partys afsd to these Presents that it shall and may be Lawfull to and for the afsd Robert Campbell to bring and Prosecute against the same Thomas Butler one or more Writ or Writs of Entry Sur Disseisin en le Post returnable before the Justices of the Provincial Court of Maryland afsd at a Court to be held for the same Province at the City of Annapolis the Second Tuesday of this Instant April of and for the afsd Granted (and) |
