220) Ex.d 1.st Nov.r 1751 I hereby Certify that Michael Macnemara Clerk of the High Court of Appeals and Errors and Register of the Admiralty Court came before me and on the day and Year aforesaid took the following Oath Viz.t You Michael Macnemara do swear that you will well faithfully and impartially to the best of your Skill and Knowledge execute your Office, and that you will not willingly or wittingly charge Ask take exact or demand any other or larger Fees for doing your Duty in your Office than is mentioned in the Act entituled An Act for amending the Staple of Tobacco for preventing Frauds in his Majestys Customs and for the Limitation of Officers Fees now in force Recorded Nov.r 27.th 1751 Robert Gordon Ex.d This Indenture made this Nineteenth Day of November In the Year of our Lord Seventeen hundred and fifty one Between Stephen Bordley of the City of Annapolis and Edmund Jenings of the same place Esquires of the one part and George Plater of Saint Marys County Esquire of the other part Whereas a certain Michael Jenifer late of S.t Marys County Deceased by his Deed of Indenture of Bargain and Sale duly Acknowledged and Recorded bearing date the Twenty fifth day of June in the Year of our Lord Seventeen hundred and twenty two and made or mentioned to be made between the said Michael Jenifer of the one part and a certain Thomas Bordley Esquire of the said City of Annapolis of the other part for and in Consideration of seventy Pounds Sterling Money and Sixty Pounds Current Money did give grant Bargain Sell Alien enfeoff and confirm unto the said Thomas Bordley all those parts or parcels of Land formerly Purchased by Thomas Sprigg from Captain Thomas Cornwallis being part of Resurrection Manor two hundred and fifty Acres part thereof being formerly in Possession of John Nuthan of S.t Marys County and by Brent Nuthan Heir at Law of the said John Sold to the said Michael the other being three hundred Acres then lately Sold by Thomas Sprigg the Heir at Law of the said Thomas the Elder to the said Michael To have and to hold the aforementioned Parcels of Land unto the said Thomas Bordley his Heirs and Assigns Subject Nevertheless to the Proviso or Condition that in Case the said Michael Jenifer his Executors Administrators or Assigns the full Sums of Seventy Pounds Sterling Money of Great Britain and Sixty Pounds Current Money of Maryland with Lawfull Interest at or upon the Tenth day of December which should be in the Year of our Lord Seventeen hundred and twenty three then the above Deed and every part thereof should be Void and of none Effect And Whereas the said Michael Jenifer or his Heirs Executors Administrators or Assigns have not paid the said Seventy Pounds Sterling or Sixty Pounds Currency whereby the same Deed and Indenture of Mortgage became Absolute And Whereas the said Thomas Bordley is also Dead leaving the said Stephen Bordley his Son and Heir at Law and having made his Testament and last Will and his Wife Ariana Executrix thereof who after proving and taking upon herself the Execution of the said Will Intermarried with Edmund Jenings and afterwards also Died having before with the Consent of the said Edmund Jenings made her Testament and last will and the said Edmund Jenings Executor thereof Now this Indenture Witnesseth that the said Stephen Bordley and Edmund Jenings for and in Consideration of the Sum of Ninety two Pounds sixteen Shillings and four pence half Penny Sterling and Seventy three Pounds and ten pence Gold Currency of this Province to the said Edmund Jenings at or before the sealing and Delivery in hand paid the Receipt whereof he doth hereby Acknowledge (and) |
