211) little Pipe Creek in Frederick County laid out for him the said Richard King Stevenson as by Certificate of Resurvey thereof bearing date the fifteenth Day of September One Thousand seven hundred and forty & nine and thereafter Granted to him for the said Quantity of five hundred and twenty five Acres of Land Together with all and singular the Houses Orchards Fencing Improvements and Appurtenances on the said two hundred and ninety Acres part of Edward & Will's Valies & Hills or the said Tract of Land called Good Will being belonging or Appertaining To have and to hold unto him the said Charles Carroll his Heirs and Assigns for ever All the said two hundred and ninety Acres of Land part of Edward and Will's Valies & Hills and all the said five hundred twenty five Acres of Land called Good Will together with their and every of their Appurtenances and the said Richard King Stevenson doth for himself and his Heirs Covenant and Agree that he the said Charles and his Heirs and Assigns shall and may have hold and enjoy the said Lands and Premisses Warranted and Defended as well against him the said Richard or any by from or under him Claiming as against all manner of Persons and Claims whatsoever Provided always and it is the True Intent and meaning of these Presents that in Case the said Richard King Stevenson or his Heirs shall and do pay or Cause to be paid unto him the said Charles Carroll or his Heirs at or before the eighteenth day of October which shall be in the Year of our Lord God One Thousand Seven hundred fifty and two the Just and full sum of Eighty Pounds Sterling Money of Great Britain with ^the^ Lawfull Interest thereof that then and in such Case the foregoing Deed of Bargain and Sale to become Null and Void otherwise to be and remain in full force and Virtue In Witness whereof and the foregoing Premisses the said partys to these Presents have Interchangeably set their hands and Seals the Day and Year first above Written Sealed and Delivered his in the Presence of Rich.d King R Stevenson Seal Jn.o Chalmers mark William Chalmers On the Back of the aforegoing Mortgage was thus Endorsed Viz.t Received of Charles Carroll the Sum of Eighty Pounds Sterling being the Consideration within mentioned I say received by me this 16.th day of October 1751 Witness his Jn.o Chalmers Rich.d King R Stevenson William Chalmers mark October 16.th 1751 Then Came before John Brice Esq.r one of the Justices of the Provincial Court the within named Richard king Stevenson and Acknowledged the within Deed according to the Act in that Case made and provided Jn.o Brice Recorded Oct.r 16.th 1751 6 1/2 Ex.d Maryland fs.t Know all Men by these Presents that We Benjamin Young of Prince Georges County Esq.r and George Steuart of Ann Arundel County Esq.r Judges and Registers of the Land Office of Maryland William Digges of Prince Georges County and Henry Roger of the same County Esq.r are held and firmly bound unto the Right Honourable the Lord Proprietary of the Province of Maryland in the full and just sum of three Thousand Pounds (Currency) |
