173) Ex.d To all to whom these Presents shall come I William Stow Lundie Esquire Mayor of the Borough of Berwick upon Tweed in the Kingdom of Great Britain do hereby Certify that on the day of the date hereof Personally came and appeared Benjamin Nicholson of Berwick afsd Brewer and Margaret his Wife and did then and there before me and in my Presence and in the Presence of James Todd of Berwick aforesaid Gentleman in due form of Law Sign Seal & as their Respective Acts and Deeds deliver and Acknowledge the Letter of Attorney above Written and the Indentures of Lease and Release hereto Annexed and in the said Letter of Attorney Specified and described in the order and manner following (to wit) the said Lease first afterwards the Release and afterwards the said Letter of Attorney And I do hereby further Certify That the said Margaret is of full Age and was Solely and Seperately Examined apart from her Husband and freely and Voluntarily consented to Execute and Acknowledge the said Indentures of Lease and Release and Letter of Attorney and that she knew the same to be a Conveyance to Barr her Title of Dower and to pass all her Interest of and in a part of a Tract of Land called Nicholson Manor lying in Baltimore County in the Province of Maryland and containing about four Thousand two hundred Acres together with all Woods Woodlands and Underwoods being parcel of or Comprised within the said four Thousand two hundred Acres In Faith and Testimony whereof I the said Mayor have Set my hand & Caused the common Seal of the said Borough of Berwick to be hereto put and affixed Dated at Berwick aforesaid the fifteenth day of March in the Year of our Lord One Thousand Seven hundred and fifty Berwick W Stow Lundie Mayor of Berwick Seal Recorded September 11.th 1751 59 1/2 Ex.d To all Persons to whom these Presents shall come or may concern I Charles Carroll of the City of Annapolis Esq.r send Greeting Whereas I the said Charles Carroll have entered up Judgments in the Provincial Court of the Province of Maryland against Samuel Howard late of Ann Arundel County Planter on two Bonds both bearing date the 26.th day of May 1745 the one of them in the Penal Sum of two hundred Pounds Sterl Conditioned for the Payment of One hundred Pounds Sterling the other in the Penal Sum of One hundred and Seventy Pounds nine Shillings Sterl conditioned for the Payment of Eighty five Pounds four Shillings and six pence Sterl with legal Interest on the afs.d several Sums of Money and on which Judgments I have Sued out Executions returnable to next Provincial Court Now Know Ye that I the said Charles Carroll for and in Consideration of the Sum of Two hundred fifty four Pounds thirteen Shillings and six Pence Sterling Money to me in hand paid by John Brice (the same being the Principal Money and Interest due on the afs.d Judgments) the receipt whereof I do hereby Acknowledge and also in Consideration of a Promisary Note past by the said John Brice to me for the Costs & Charges which have already and which shall hereafter Accrue due on Entring up the said Judgments and Suing out Executions thereon Have Sold Assigned Transferred and made over and by (these) |
