174) these Presents for myself my Heirs Executors & Adm.rs do hereby Sell Assign Transferr and make over unto him the said John Brice his Heirs and Assigns for ever the afs.d two several Judgments so as afs.d entered up by me in the Provincial Court as afs.d against the said Samuel Howard together with the Money and Tobacco in them severally mentioned and all my Right Title Interest & Property therein or to any part or parcel of them or either of them To have and to hold the said two Judgments and the Money and Tobacco in them severally mentioned unto him the said John Brice his Heirs and Assigns for ever to the only proper Use and Behoof of him the said John Brice his Heirs and Assigns & to & for no other Use Intent or Purpose whatsoever And I the said Charles Carroll do hereby Constitute and Appoint the said John Brice Irrevokably my True and Lawfull Attorney in my Name or ^in^ his own Name as my Assignee to Ask Demand Sue for Levy Recover and Receive of and from the said Samuel Howard his Heirs Exors or Adm.rs the Principal Money and Interest now due or which shall hereafter arise due on the afsd two Judgments together with the Costs of Suit in them severally mentioned and the same Money and Tobacco when received to apply to the said John Brice's proper Use and Behoof hereby ratifying and Confirming all and whatsoever my said Attorney shall Lawfully do or cause to be done in the Premisses Provided always and it is the True Intent and meaning of these Presents that neither I myself my Heirs Exors or Adm.rs are not to be Answerable to the said John Brice his Heirs Ex.rs Adm.rs or Assigns nor to any other Person or Persons Whatsoever for the Principal Money mentioned in the said Judgments nor Interest now become due or which shall hereafter arise due thereon nor for any Costs or Charges that shall or may arise by means of this Assignment but therefrom and from every part and parcel thereof shall and will forever hereafter be Absolutely Acquit and Discharge In Witness whereof I have hereunto set my hand and Affixed my Seal this 12.th day of September Anno Domini 1751 Sealed & Delivered in the Presence of Char Carroll Seal Richd Burdus Thomas Johnson jun.r On the back of the aforegoing Assignment was thus Endorsed (Viz.t) I Acknowledge to have reced on the twenty sixth day of August 1751 of John Brice within named the Sum of two hund.d and fifty four Pounds thirteen Shillings and six pence Ster Money and a Promisary Note for the Costs of Suit within mentioned the same being in full for the within mentioned Consideration said to be paid by the said John Brice to me as Witness my hand Witness Richard Burdus Char Carroll Mem on the 12.th day of Sept.r Anno Dom 1751 The within Named Charles Carroll Esq.r Acknowledged the within Assignment as his Act and Deed and the Money and Tobacco therein mentioned to be the Right and Estate of the within named John Brice his Heirs and Assigns for ever according to the directions of the Act of Assembly in such Cases made & Provided 7 1/2 Recorded Sept.r 12.th 1751 John Darnall |
