170) his Justices for Kent County in the same Province and by Virtue of the Power and Authority to him Granted and given by the same Warrant as Attorney for the same Joseph Benjamin and Margaret Samuel and Elizabeth & in their Names and Behalf did Acknowledge the within Written Indenture of Deed of Release to be the Act and Deed of them the said Joseph Benjamin Margaret Samuel and Elizabeth & for the Uses Intent and Purposes therein mentioned ^ and the lands & Premisses therein mentioned^ to be granted to be by Virtue thereof the Right and Estate of Samuel Ogle and Benjamin Tasker Esq.rs within named to and for the Uses and Purposes therein mentioned In Testimony whereof We have hereunto set our hands the day and Year first above Written B Hands Cha.s Scott On the 5.th Day of September Anno Dom 1751 Hannah Nicholson Wife of Joseph Nicholson one of the Bargainors within named Personally came before Us the Underwritten two of the Right Honble the Lord Proprietary of the Province of Maryland his Justices of Kent County in the same Province and freely Acknowledged the within Writs & Deed of Release to be her Voluntary Act and Deed and the Lands and Tenements with their Appurtenances therein mentioned to be Granted to be by Virtue thereof the Right and Estate of Samuel Ogle and Benjamin Tasker Esq.rs according to the True Intent and meaning of the same Deed And the same Hannah having been Privately by Us examined out of the Sight and Hearing of her said Husband saith that she makes the same Acknowledgment Voluntarily and Freely and without being Induced thereto by fear or threats of or Ill Usage from her said Husband or for fear of his Displeasure In Testimony whereof We have hereunto set our hands the day and Year aforesaid B Hands Cha.s Scott I James Smith Clk of Kent County do hereby Certify That M.r Beddingfield Hands & M.r Charles Scott Gent before whom the above & within Acknowledgements were taken & at the time of taking the time of taking Kent Co.ty the same and still are two of his Lordships Justices of the Peace for Kent Court Seal County being thereunto Lawfully Commissioned and Sworn In Testimony whereof I have hereunto set my hand and affixed the Publick Seal of Kent County aforesaid this 5.th day of September Annoq Domini 1751 Jam.s Smith Clk K.t Co.ty Know all Men by these Presents that Joseph Nicholson of Chester Town in Kent County in the Province of Maryland Merchant Benjamin Nicholson of the Borough of Berwick upon Tweed in the Kingdom of Great Britain Brewer and Margaret his Wife and Samuel Nicholson of Stockton upon Tease in the County of Durham in the same Kingdom Doctor in Physick and Elizabeth his Wife Have and each and every of them Hath made ordained authorized constituted and appointed and by (these) |
