153) Sheep Wheat Corn and Tobacco at his Plantation over Severn and his Plantation on Elk Ridge whereon Richard Young is Over seer and his Plantation near the Barrens Called Pressley whereon a Certain William Deverin is Overseer and all the Household and other Furniture belonging to the aforesaid three Plantations As also all my House hold Furniture belonging to my Dwelling House at Annapolis Gold Silver Copper Brass Pewter Iron Table Linnen Sheeting Linnen Beds Bolsters and Pillows Ruggs and Blanketts Bedsteads Tables Dressing Tables Chairs with all the House hold stuff and Furniture whatsoever belonging to my said Dwelling House with a List of all my Outstanding Debts in Money and Tobacco to be given in upon Oath and to be mentioned in a certain Schedule to be hereunto Annexed with my Gold Watch and my Gray Riding Horse called Paca As also all my White Servants Negroes and Molattoes belonging to me with all my Books as P a Catalogue of the Books and List of the ^said^ White Servants Negroes and Mollatoes hereunto Annext and all his Right Title and Interest of in and to the same To have and to hold all and singular the said Lands and Tenements Goods and Chattels Servants Negroes and Mollattoes House hold stuff and Furniture and List of outstanding Debts hereby Bargained and Sold Assigns and made over or intended to be hereby Bargained & Sold Assigned or made over or Intended to be hereby Bargained & Sold Assigned and made over unto the said William Cumming the Younger his Heirs Ex.rs Adm.rs (except the said Mortgage of the said Philip Hammond that is to be Redeemed) as his own Proper Lands and Tenements Goods and Chattels upon Special Trust and Confidence Nevertheless and the true Intent and Purpose That the said William Cumming the younger his Heirs Ex.rs Adm.rs or Assigns or his Attorney or some or one of them shall and will by Sale of the said Lands and Tenements Negroes Goods and Chattels Levy and Raise Money and therewith pay and satisfy in part or whole all the Debts that are now owing and due by the said William Cumming the Elder unto his Several and Respective Creditors so far forth as the Money arising by such Sale will amount to by even and equal Coheirs to be divided among the Several Creditors of the said William Cumming the Elder in Proportion to their Several and Respective Debts And the said William Cumming the Elder Doth by these Presents Impower the s.d William Cumming the Younger his Exec.rs Adm.rs or Assigns one or more Attorney or Attorneys for the Purposes af.d under him or them to make and again to recall hereby Ratifying Confirming and holding for good and Valid all and whatsoever the said William Cumming the Younger his Ex.rs Adm.rs or Assigns or his Attorney or Attorneys shall Lawfully do or cause to be done in and about the Premisses by Virtue of these Presents But if it should happen that the Several and Respective Creditors of the said William Cumming the Elder shall refuse to Accept in part of Satisfaction of their Several and Respective Debts or Proportionable part of the Money arising on such Sale as aforesaid then it shall and may be Lawfull to and for the said William Cumming the Younger his Ex.rs Adm.rs or Assigns to take Receive (Possess) |
