142) and Parcel thereof with their and every of their Rights Members and Appurtenances And also all the Estate Right Title Interest Use Possession Trust Inheritance Claim and Demand whatsoever of the said Samuel Hyde of in to or our of the same Premisses and every or any part thereof Together with all such Deeds Grants Charters Patents Evidences Fines Recoveries Escripts Minuments and Writings whatsoever touching or concerning the same and every or any part thereof as the said Samuel Hyde then had in his Custody or Power or could come by without Suit in Law or Equity To hold the said Plantations or Tracts of Land and all and Singular other the Premisses with their and every of their Rights Members and Appurtenances therein before Granted Bargained Sold Aliened Remised Released and Confirmed or thereby intended so to be And every part and parcel thereof unto the said Charles Lord Baltimore his Heirs and Assigns to the only proper Use and Behoof of the said Charles Lord Baltimore his Heirs and Assigns forever And to or for no other Use Intent or Purpose whatsoever as by the said recited Indentures relation being thereunto had may appear And Whereas the afs.d two Tracts of Land were on the Twenty ninth day of June in the Year of our Lord One Thousand Seven hundred and fifty by the direction of the said Charles Lord Baltimore set up to Publick Vendue by Auction to the highest bidder (Notice of the Place and Distant time thereof having been duly given) at which said Sale the said Ignatius Digges was the highest Bidder at Seven hundred and sixty Pounds Sterling for the first mentioned Tract of Land called his Lordships Kindness and at Seven hundred and ten pounds like Money for the last mentioned Tract called the several Tracts Now this Indenture Witnesseth That the said Charles Lord Baltimore for and in Consideration of the Sum of One Thousand four hundred & Seventy Pounds Sterling Money of Great Britain (being the Totall of the two af.d Sums of Money) to him in hand ^paid^ by the said Ignatius Digges at or before the Sealing and Delivery of these Presents the receipt whereof he doth hereby Acknowledge and thereof and therefrom and of and from every part and parcel thereof doth hereby Acquit Exonerate and Discharge the said Ignatius Digges his Heirs Executors Administrators and Assigns Hath Granted Bargained Sold Aliened Remised Released Enfeoffed and Confirmed and by these Presents Doth Grant Bargain Sell Alien Remise Release Enfeoff and Confirm unto the said Ignatius Digges (in his Actual Possession now being by Virtue of a Bargain and Sale to him thereof made by the said Charles Lord Baltimore bearing date the day next before the day of the date thereof and by force of the Statute for Transferring Uses into Possession) his Heirs and Assigns All that Plantation or Tract of Land commonly called his Lordships Kindness Containing by Estimation Six Thousand and Seven hundred Acres of Land be the same more or less And also all that other Plantation or Tract of Land called or known by the Name of the Several Tracts Containing by Estimation (Two) |
