134) Doctor Charles Carroll his Heirs and Assigns for ever One fifth part to Charles Carroll Son of Daniel Carroll his Heirs and Assigns for ever as Tenants in Common and not as Joint Tenants to take by Survivorship against any Person or Persons whatsoever Claiming or to Claim from by or under him the said John Nicholson or his Heirs And the said Daniel Nicholson doth Covenant and Agree to and with the said Daniel Dulany Esquire and Company that he the said Daniel Dulany Esquire and Company their Heirs and Assigns for ever the said One hundred Acres of Land shall and may Peaceably hold and Enjoy as well against him the said John Nicholson and his Heirs as against any other Person or Persons whatsoever In Witness whereof and the foregoing Premisses the said Partys to these Presents have Interchangeably set their Hands and Seals the day and Year first above Written The mark of D Daniel Seal Nicholson On the back of the aforegoing Deed was thus Endorsed Viz.t Sealed and Delivered in the Presence of Jn.o Brice W.m Webb 1751 Received the day and Year within Written of the within Named Daniel Dulany Esq.r £ and Comp.y the full Sum of Ten Pounds Curr Money of Maryland being the Consideration 10 within mentioned to be paid by him to me I say received by Witness The D mark Jn.o Brice of Daniel Nicholson W.m Webb 1751 May 14.th 1751 Then Came before me the Subscriber one of the Justices of the Provincial Court the within Named Daniel Nicholson and Acknowledged the within Deed according to Law Jn.o Brice May 16.th 1751 Then received for the Use of the Right Honourable the Lord Baltimore four Shill.s Sterling being for the Alienation fine of the within one hundred Acres of Land 6 Recorded May 16.th 1751 Benj.a Tasker Maryland fs.t Ex.d This Indenture Made this Twentieth Day of February in the Year of Our Lord Seventeen Hundred and Fifty Between Arthur Lee of Charles County and Charles Jones of the same County Whereas William Courts by Indenture properly Acknowledged and Recorded in pursuance of an Act of Assembly of this Province in such Case made and provided and under the Hand and Seal of the said William Courts and bearing Date the Seventeenth Day of April Seventeen hundred and Fifty for the Consideration therein Specified Did Give Grant Bargain and Sell unto the said Arthur Lee and Charles Jones their Heirs and Assigns for Ever All that Tract or parcell of Land Called Clear Drinking Situate Lying and being on the West Side of Rock Creek Branch in Frederick County under the Metes and Bounds Described and Expressed in the said Indenture together with All and Singular the Appurtenances thereunto belonging To have and to hold the said Tract or Parcell of Land as aforesaid to them the said Arthur Lee and Charles Jones their Heirs and Assigns for Ever to them and their proper Use and Behoof as by the said Recited Indenture Referrence being thereunto had may more at Large Appear By Virtue of which said Grant or Conveyance the said Arthur Lee and Charles Jones are now Jointly Seized in their Possession in their Demesne as of fee of the Land and Premisses here before mentioned to be to them Granted Now this Indenture Witnesseth that the said Arthur Lee and Charles Jones do by these presents make a full perfect and absolute Partition of the said Land and all the Premisses to them Granted by the above Recited Indenture to and amongst them the said Arthur Lee and Charles Jones in manner and form following that is to Say by Dividing the said Land into Two parts by Running a Line from a Marked Oak standing on or near the Creek aforesaid on the East Side of the said Land Running North Seventy Nine Degrees West Four Hundred and Twenty four Perches to the South Line of the said Tract or Parcell of Land And that the said Arthur Lee and his Heirs and Assigns shall have hold Occupy and Enjoy to him the said Arthur Lee his Heirs and Assigns to the only use and Behoof of the said Arthur Lee his Heirs and (Assigns) |
