122) and Possest herself of the same or the greatest part thereof Did of their own free Will and Accord make Constitute and Appoint Bryan Philpot the younger Merchant in Maryland aforesaid to be their true and lawfull Attorney and Procurator for them and in their Names and to their Use to Call the said Elizabeth Carpenter to an Account for the Personal Estate of her late Intestate Husband in Maryland and and for them and for their Use to Ask Demand Sue for recover and receive from her the said Elizabeth Carpenter all such Goods Chattels Sum and Sums of Money as is are or shall be due and payable unto them any or either of them for their any or either of their share or Shares Dividend or Dividends of the said John Carpenter's Personal Estate in Maryland afsd and to Sell and Dispose thereof or to Compound and Agree with her for the same in such manner as he shall think fitt and upon Receipt of such Share or Shares Dividend or Dividends or Composition Money or any other Sum or Sums of Money Acquittance or Acquittances or other reasonable discharge and discharges for them and in their Names to make Seal and Deliver as their Several Acts and Deeds and Generally to do Execute and perform all such other Lawfull Act and Acts thing and Things whatsoever as shall be requisite and necessary to be done in or about the Premisses as fully and effectually as they the said Constituents might do or cause to be done were they Personally present promising hereby to ratify and Confirm all and whatsoever their said Attorney and Procurator shall do or cause to be done in or about the Execution of the said Premisses In Witness whereof the said Constituents have hereunto Subscribed their Names and set their Seals in the Presence of me the said Mayor and the said Notary Publick who have in Testimony of the said Premisses hereunto set our Names and Publick Seals being thereunto requested the day and Year aforesaid Seal Ann Radcliffe Seal Lewis Portbury Mayor Joseph Elliott Seal of Exeter Mary Elliott Seal Jn.o Burnett Seal Richard Langworthy Dorothy Burnett Seal Notary Publick 6 Recorded April 2.d 1751 Ex.d This Indenture made this Twenty third of March in the Year of our Lord Seventeen hundred and fifty Between George Parker of Charles County Gentleman of the one part and his Excellency Samuel Ogle Esq.r of the other part Whereas the said George Parker together with Richard Pile and William Pile by his Bond or Obligation duly Executed bearing date the twentieth day of February in the Year of our Lord Seventeen hundred and fifty stands Bound to the said Samuel Ogle in the Sum of five hundred Pounds Sterling Conditioned for the Payment of the Sum of two hundred and fifty Pounds Sterling with legal Interest for the same at or upon the first day of February next ensuing the date of the said Bond or Obligation Now this Indenture Witnesseth that the said George Parker in Consideration of the said Debt or Sum of two hundred and fifty Pounds Sterling and for the better Securing the Payment thereof with Interest to the said Samuel Ogle his Executors Administrators or Assigns according to the Condition of the said Bond and also in Consideration of the further Sum of five Shillings to him the said George Parker by the said Samuel Ogle at or before the Sealing and Delivery of these Presents likewise well and truly paid the receipt whereof his hereby Acknowledged Hath Granted Bargained (Sold) |
