11) for Ever shall and may Quietly and Peaceably Have hold and Enjoy the said Bargained Premisses with its Appurtenances in Fifth parts as afs.d that is to say one full Moiety of the said Tract of Land called New Town as well against him the said Stephen Steward or any Pson or Psons of by from or under him Claiming as against all manner of Psons or Claims whatsoever well and sufficiently Warranted and Defended And the said Stephen Steward Doth likewise Covenant and Agree that at any time within the Space and Term of Seven Years from the Date hereof he the said Stephen Steward shall and will Do and Execute or suffer to be done and Executed any further Deed or Deeds for the better and more suremaking Over the said Land and Premisses which they the said Benjamin Tasker Daniel Dulany and Mess.rs Carrolls they or either of them their or either of their Heirs or Assigns or their or either of their Council Learned in the Law shall Advise or Devise In Witness whereof and the foregoing Premisses the said Partys to these Presents Have Interchangeably set their Hands and Affixed their Seals the Day and Year first above written Signed Sealed and Deliv.d Stephen Steward Seal in the Presence of Danl Dulany Jun.r W.m Baker On the Back of the aforegoing Deed was thus Endorsed Viz.t 1749 Nov.r 6.th Received of Benjamin Tasker Daniel Dulany Esq.rs and Mess.rs Carrolls the Sum of five Pounds being the Consideration within mentioned Test Dan.l Dulany Jun.r P Steward Steward W.m Baker 1749 Nov.r 6.th Then came before me the Subscriber one of His Ldps Justices of the Provincial Court Stephen Steward and acknowledged the 9 1/2 within Deed according to ^the^ Act of Assembly in such cases made and Provided Recorded November the 6.th 1749 Robert Gordon X.d To all to whom these Presents shall come the Right Honourable Charles Lord Baron of Baltimore Doth send Greeting Know Yee that the said Lord Baltimore Hath made Ordained Constituted and Appointed and by these Presents Doth make Ordain Constitute and Appoint Benedict Calvert of Annapolis in the Province of Maryland Esq.r His Lordships true and Lawfull Attorney for him and in his name and on his Behalf to put up and Sell and Publick Vendue to the Highest Bidder the following Tracts of Land lying in Prince Georges County in the Province afs.d to wit One Tract of Land called or known by the Name of His Lordships Kindness Containing and laid out for Six Thousand Seven Hundred Acres more or less as also several other Tracts of Land Contiguous to the Tract of Land abovementioned lying in the said County and Containing and laid out in all for Two Thousand five Hundred Acres more or less together with One Hundred and twenty Negroes or as many of them as are living All which said Land and Negroes were formerly the Property of Samuel Hyde of London Merchant & Comp.a And upon Receipt of the Consideration Money to Arise by such Sale for him the said Lord Baltimore and on his Behalf to Sign Seal and Execute such Assignment or (Assignments) |
