78) Act & Deed according to the Directions of the Act of Assembly in such Case made & provided Acknowledged before me the Subscriber one of his Lordships Provincial Justices Day & Date first above written John Hepburn 29.th May 1745 Received the Sum of Twelve Shillings Sterling being the Alienation fyne for the within three hundred Acres of Land for the Use of the Right Honble the Lord Propry 7 1/2 Recorded May 29.th 1745 vide recovery recorded in Lib E I N.o 9 fol 337 Ex.d This Indenture made this 14.th Day of May in the Year of our Lord One thousand Seven hundred forty five Between Joseph Thomas of Baltimore County in the Province of Maryland of the one Part & Charles Carroll of the City of Annapolis in the Province af.d Chyrurgeon of the other Part Witnesseth that the said Joseph Thomas for & in Consideration of Twenty pounds Sterling Lawfull Money of Great Britain to him in hand paid by the said Charles Carroll the Receipt whereof the said Joseph Thomas doth hereby Confess & acknowledge he the said Joseph Thomas hath Granted Bargained sold aliened Enfeoffed and Confirmed and by these Presents Doth give grant bargaine sell alien enfeoff and Confirm unto the said Charles Carroll his Heirs & Assignes for Ever All that one half Part or Moiety of a Tract of Land Called or known by the Name of Fulks Forrest Originally granted to a Certain Edward Fulke's for the Quantity of Two hundred Acres of Land more or less which said half Part or Moiety of the said Land is the most Southern or South East Part of the said Land Which said Land lyeth on the North East run or Branch of Back River in Baltimore County af.d together with all Profits Benefits Priviledges & Appurtenances unto the same belonging or in any ways appertaining To Have and to hold the said Lower or most Southern or South East Part divided by a Line drawn a Cross the said Land Called Fulke's Forrest & every Part & Parcell of the said Lower ^half^ Part or Moiety of the af.d Tract of Land as above mentioned unto him the said Charles Carroll his Heirs & Assignes for Ever And the said Joseph Thomas for himself his Heirs Exors & Adm.rs doth Covenant & Agree to and with the said Charles Carroll his Heirs & Assignes that in Case the (af.d) |
