570) Ex.d This Indenture Tripartite made the Eleventh Day of April in the Year of our Lord God One Thousand seven hundred forty and Nine Between Samuel Fountain of Dorchester County in the Province of Maryland Merchant of the first part Robert Jenckins Henry of Somerset County in the Province afs.d Gentleman of the Second Part and Ephraim Wilson of Somerset County in the Province afs.d Gentleman of the third Part Witnesseth that for the Docking Barring of all Estates Tail of and in the Messuage or Tenement Lands and Tenements herein after mentioned with their Appurtenances and all and every the Reversion and Reversions Remainder and Remainders thereupon Dependant or Expectant and for Setling and Assuring the same to for and upon the Uses Intents and Purposes herein after Limitted Expressed and Declared and for and in Consideration of five Shillings Current Money of the said Province of Maryland to the said Samuel Fountain in hand paid by the said Robert Jenckins Henry at or before the Sealing and Delivery of these Presents the Receipt whereof is hereby acknowledged and for Divers other good Causes and Considerations him the said Samuel Fountain in this Behalf moving Hath Granted Bargained and Sold Released & Confirmed and by these Presents Doth Grant Bargain Sell Release & Confirm unto the said Robert Jenckins Henry and to his Heirs ^and Assigns^ for Ever All that Tract or Parcell of Land called Samuels Part it being part of a Tract of Land ^formerly^ called Berrys Lott Situate lying and being in Somerset County on the South side of a Creek that is called and known by the name of Back Creek bounded as followeth Beginning at a marked Pine standing by a Creek side it being the first Bounder of a Tract of Land called Nova Francha thence with a line Drawn South three hundred and twenty Poles to a marked Pine standing by the side of a Swamp thence East thirty two Poles thence North three hundred and twenty Poles and from thence with a Right Line drawn to the first Bounder Containing and now laid out for Sixty four Acres of Land be the same more or less together with all Edifices Buildings Orchards Gardens Improvements Profits Previledges Hereditaments and (Appurtenances) |
