542) to the said Henry Welsh in Hand paid by the said Mary Higgens in part of her Marriage Portion the Receipt whereof he doth hereby acknowledge and for the making ^a^ Provision for a Maintenance and Livelihood for the said Mary Higgens in Case she shall happen to Outlive the said Henry Welsh her intended Husband and for the Setting the Messuages Lands Tenements and other Estate both Real and Personal to such Uses and to and for such Intents and Purposes and with and under such Provisoes Limitations and Agreements as are herein after Limited and expressed concerning the same if the said Marriage shall take Effect He the said Henry Welsh Hath Granted Sold Released and Confirmed And by these Presents Doth Grant Bargain Sell Release and Confirm unto the said Mary Higgens the afs.d Five Negroes Names Lucy, Ann, Eleanor, Mary and Davis Messuage with their Increase and Dwelling Plantation whereon the said Mary Higgens now lives to her and her Heirs and Assigns for Ever So that the same is not to any Part of the Estate of the said Henry Welsh And that it shall and may be Lawfull for the said Mary Higgens at any time by Writing or by her last Will and Testament to Dispose of the afs.d Land Premisses and Negroes to whom and in what manner she shall think fit which he the said Henry Welsh will Allow of and Confirm And for as much as he the said Henry Welsh is not at Present Posest of a Sufficient Estate to make a Jointure for the s.d Mary Higgens Equivalent to her Fortune He the said Henry Welsh for himself his Heirs and Assigns Covenants Premises and Grants to and with the said Mary Higgens her Heirs and Assigns that in Case the said Intended Marriage shall take Effect and he the said Henry Welsh should happen to Dye in the lifetime of the said Mary Higgens that then she the said Mary Higgens shall and will and is hereby Intituled to her Legal Dower of his Real Estate and Intituled to one half of his whole Personal Estate clear of all Debts to be at her ^own^ Disposal and to be by her taken and Received to her own seperate Use and Benefit In Witness whereof the Parties to 5 1/2 these Presents have hereunto Interchangeably set their Hands and Seals the Day and Year first above Written Sealed and Delivered Henry Welsh Seal in the presence of William Cumming Mary Higgens Seal Geo Luxford Recorded 28.th Jan.ry 1748/9 |
