448) Hyde should be Condemned at either of the said Suits should be shared Equally (that is to say) that the said George Plater should have one Moiety or half part and the said George and Onorio as Executors af.d should have the other Moiety or half part and not in Proportion to their Claims And also reciting that Whereas several Attachments were Obtained in Pursuance of the said Writs and by Virtue of such of the said Attachments as were issued in the Name of the said George Plater only Several Negroes and other moveable Effects and Estate belonging to the said Samuel Hyde were Attached and Condemned for the use of the said George Plater And also by virtue of such of the said Attachments as were issued in the name of the said Executors for the Benefit of the said Elizabeth Calvert several Tracts and Parcells of Land were Attached and Condemned in the name of the said Executors And further Reciting That Whereas the said Elizabeth Calvert in Virtue of the said Argument was Intituled to some part or Portion of the said Negroes and other Moveable Effects or the Produce or value thereof so Condemned for and in the Name of the said George Plater as af.d And also the said George Plater was Intituled to some part or Portion of the Lands So Condemned in the Name of the said Executors in Lieu or Satisfaction of such part of the said Negroes and other moveable Effects as the said George Plater should either by a thereafter Argument or Judgment of any Court deliver or pay for the Benefit of the said Elizabeth out of what had been Condemned in his own name as af.d But forasmuch as the said Executors in whose names and at whose Suit the said Lands were so Condemned were only Trustees for the use and Benefit of the said Elizabeth (who) |
