447) proved and (the said) Benjamin Tasker having Renounced the Executorship Obtained Letters Testamentary thereof And also Reciting that Whereas the said Charles Calvert having in his lifetime dealt with and Remitted Several Sums of Money to a Certain Samuel Hyde of London Merchant so that a Ballance in Account was due to the said Charles Calvert at the time of his Death The said Executors Continued the Correspondence with the said Samuel Hyde on Account of the said Charles Calverts Estate whereby a Considerable Sum of Money amounting to near six hundred pounds Sterling became due to the said Estate from the said Samuel Hyde who afterwards failed in his Credit and declined his Trade in the Province And also further reciting that Whereas the said George Plater having also in his own Seperate Right had dealings with the said Samuel Hyde there became due to the said George Plater in his own Right from the said Samuel Hyde a Debt amounting to above nineteen hundred Pounds Sterling And also reciting that Whereas in order to secure the Payment of the said Several Debts the said George Plater in his own Right as well as together with the said Onorio Razolini as Executors af.d and for the Benefit of the said Elizabeth the Daughter (the said other Daughter Anne having dyed an Instant many years before) issued Several Writs out of the Provincial Court of this Province in Order to Obtain Attachments against the Estate and Effects of the said Samuel Hyde but on issuing such Writs the said George Plater for himself in his own Right And the said Onorio Razolini for and on behalf of the said Elizabeth Calvert entered into an Argument puporting that Whatever Effects of the said Samuel (Hyde) |
