       Thomas Barkley Doth by these presents make Ordain
       Constitute Authorize and Appoint the said James Russell His
       True and Lawfull Attorney irrevocable in his Name place &
       stead or in the Name of him the said James Russell His
       Ex.rs Adm.rs or Assigns and for the only and proper use of the
       said James Russell his Exers Adm.rs & Assigns to Sue and
       Prosecute the said James Bayard or any other Person or Persons
       whatsoever for Recovery of the said seventy five Thousand
       Pounds of Tobacco and upon payment thereof or any other end
       Composition or agreement made Concerning the Premisses
       acquitances & Discharges to give either in the Name of the
       said James Russell His Exers Adm.rs or Assigns or the said
       Thomas Barkley his Exers Adm.rs or Assigns and further to
       do all and every other Act and Acts thing and things whatsoever
       which shall be requisite and needfull to be done in or
       about the Premisses ^so fully as the said Thomas Barkley might or could do the same being personally Present^ Provided Nevertheless and it is the
       True Intent and meaning of these presents and the parties
       thereto that if the said Thomas Barkley his Exers Adm.rs
       or Assigns or any of them do and shall well and Truly pay or
       Cause to be paid unto the said James Russell his Exers Adm.rs or
       Assigns the aforesaid several sums of Two hundred and Eight
       Pounds Sterling Money and of five Shillings Current Money and
       or upon the last Day of August next to come with Legal
       Interest for the same from the Date hereof then these presents
       and every Clause and Article her vir shall Cease & be utterly Void &
       of No Effect and the said Thomas Barkley for himself His
       Heirs Exers Adm.rs and Assigns Doth hereby Covenant
       Promise and Agree to and with the said James Russell His
       Exrs Adms and Assigns that he the said Thomas Barkley
       His Ex.rs Adm.rs or Assigns shall and will on or before the said last
       Day of August in the said Year one thousand seven hundred
       and forty seven pay or Cause to be paid unto the said James
       Russell his Ex.rs Adm.rs or Assigns the said Several Sums of
