229) Ex.d This Indenture made the Tenth Day of July in the Year of our Lord one Thousand seven hundred & forty six Between John Hall of Lyons Creek in Calvert County Gent of the one Part and William Hall of Elkridge in Annarundel County Gentleman of the other Part Witnesseth that the said John Hall for and in Consideration of the sum of one hundred and twenty three Pounds Ten Shillings Sterling Money of Great Britain to him in hand Paid by the said W.m Hall & for Divers other Good Causes and Considerations him hereunto Moving it is hereby Covenanted, Granted, Concluded & agreed by and between the Partys to these Presents for them & their Heirs that it shall and be Lawfull for the said W.m Hall before the last Day of the next Provincial Court to Prosecute out of the High Court of Chancery one or more Writ or Writs of entry sur Disseisin in the Post against the said John Hall returnable in the next Provincial Court whereby the said W.m Hall shall and may Demand against the said John Hall one undivided Moiety of all that Moiety of a Tract of Land called Talbotts Resolution Manor lying in Annar.ll County in the Woods on a ridge Called Elkridge which said Moiety lyes to the Northward of the Dividing Line of the said Tract of Land called Talbotts Resolution Manor by such Name or Names Quantity or Quantities of Acres as shall be thought fit & requisite to which Writ or Writs the said John Hall shall appear in his proper Person & shall Vouch over to Warrantee the Common Vouchee & the Common Vouchee shall appear & Imparle and afterwards shall make Default whereby one or more Recovery or recoverys, Judgment or Judgments may be had and give for the said W.m Hall for recovery of the said Land and Premisses as afs.d against the said John Hall and for the said John Hall to recover ^over^ in Value against the Common Vouchee according to the manner & Form of Common Recoverys in such Cases used & it is further Covenanted, Granted, Concluded & agreed by & (between) |
