92) Ex.d This Indenture made the twenty ^third^ Day of March in the Year of our Lord Seventeen hundred and thirty Eight Between Thomas Broad of Baltimore County Planter of the one Part And Benjamin Tasker of Annapolis Esq.r of the other Part Witnesseth that the said Thomas Broad for and in Consideration of fourteen Pounds three Shillings sterl to him in hand paid by the said Benjamin Tasker The Receipt whereof the said Thomas Broad doth hereby acknowledge and the said Benjamin Tasker thereof and of every Part thereof doth acquit and Discharge Hath Given Granted bargained sold and Confirmed And by these Presents doth give Grant bargaine sell and Confirm unto the said Benjamin Tasker All the Lower part of that Tract or Parcell of Land called Broads Improvement lying and being in Baltimore County running up the first line from the Beginning One hundred and Sixty two Perches and so at Right Angels a cross and with the Outward lines Containing by Estimation One hundred Acres be the same more or less together with all Buildings Improvements Profits Comodities Advantages and Appurtenances thereunto belonging or deemed reputed or taken as Part Parcell of Member thereof To have and to hold to him the said Benjamin Tasker his Heirs and Assignes for Ever to the Uses Intents and Purposes herein after mentioned (that is to say) One fifth Part thereof to the Use of the said Benj.a Tasker his Heirs and Assignes for Ever One other fifth Part thereof to the Use of Charles Carroll of Annapolis Esq.r his Heirs and Assignes for Ever One other fifth Part thereof to the Use of Charles Carroll of Annapolis Surgeon his Heirs and Assigns for Ever one other fifth Part thereof to the Use of Daniel Dulany of Annapolis Esq.r his Heirs & Assignes for Ever & the other fifth Part thereof to the Use of Charles Carroll Son & Heir of Daniel Carroll late of Prince Georges County Gentleman deced his Heirs & Assignes for Ever And to no other Use intent or Purpose whatsoever And the said Thomas Broad for himself and his Heirs doth Covenant and Agree to & with the said Benjamin Tasker his Heirs and Assignes that he the said Thomas Broad at the time of the Ensealing and Delivery of these Presents is lawfully and rightfully seized in his Demesne as of Fee of and in all and Singular the bargained Premisses & hath good right Absolute & Lawfull Authority to sell and Convey the Same And that he the said Thomas Broad & his Heirs shall & will for Ever Defend all & singular the Premisses to the said Benj.a Tasker his Heirs and Assignes to the Uses & Purposes af.d freely Absolutely & Clearly discharged from all Persons Claims and Incumbrances whatsoever the Rents & Services hereafter to grow Due to the Lord Proprietary for or in respect of the Premisses excepted and foreprized And the said Thomas Broad doth further Covenant and Agree to and with the said Benj.a Tasker his Heirs & Assignes that he the said Thomas Broad at the reasonable request and Proper Cost & Charge of the said Benj.a Tasker his Heirs or Assignes shall and will do and Execute & Perform any further or other Act Conveyance or Assurance what (wth) |
