426) Fine of the within Lands Benj.a Tasker 8 s.ds Recorded July the 8.th 1743 Ex.d Maryland fs.t Whereas I William Chapman Master of the Ship Edward now in Patuxent River did on the fifteenth September Last degree to and with Thomas Caton John Hepburn and James Wardrop under the Penall sum of two hundred pounds Sterling that they the said Caton Hepburn and Wardrop should Ship on Board the said Chapman's Ship in eighty Days from the Date thereof one hundred Hogshead of Tobacco which said agreement or Charter party is not fully complyed with by them the said Caton Hepburn and Wardrop Now for and in consideration that M.r Isaac Milner of London Merchant Charter the said Ship of John Clarke and is to pay full freight Loaded or not Loaded for the said consideration I do hereby Assign transfer and make Over to the said Isaac Milner his heirs or Assigns all the full Penalty afs.d with all benefits Advantages or Interest that shall be recovered or become due to said William Chapman by reason of the said Caton Hepburn and Wardrop's not Complying with the afs.d agreement hereby giving and Granting to the said Milner all my right Title and interest thereto and I do hereby Order Nich.o Maccubbin whom I have appointed my attorney to receive and recover the same to apply it to the use and Benefit of the said Isaac Milner his heirs or Assigns given under my hand and Seal this 5.th Day of January 1742 John Chadock W.m Chapman Seal Robert Greves On the Back of the aforegoing Deed was thus Endorst Viz.t Calv.t County fs.t John Chaddock made Oath on the holy Evangelist, that he saw Cap.t William Chapman Sign Seal (and) |
