(170) and may have hold & enjoy the af.d parcell of Land vizt the Great Plantation at Patuxant part of Delabrook Mann.r supposed to Contain one thousand Acres Nine hundred & seventeen Acres of Land lying at or about S.t Marys County Courthouse Two hundred & twenty acres of land part of Beaverdam Man.r af.d & the af.d tract of land Called Wallington lying in the County last afd & laid out for three hundred and fifty acres And likewise all other Lands lying in S.t Marys County af.d w.ch the s.d Nich.s Lowe in his life time had right to and w.ch are not herein particularly Named from time to time for ever Discharged Acquitted and Saved harmless of and from all former bargains Sales leases Charges and Incumbrances had made done or suffered by the s.d Henry Darnall & Elizabeth his Wife the af.d Edward Neale on the s.d Francis Hall & Dorothy his Wife or either of them Since the Death of the said Nicholas Lowe And Lastly the parties af.d for themselves and their heirs Do Covenant Grant & Agree to & with every other severally & their several heirs to the Intent that all Disputes & Controversies hereafter between them their heirs & assigns may intirely be extinguisht & taken away in manner & form following That is to say that if it shall so happen that any of the parties af.d shall hereafter be evicted expelled or ejected by any former right from any part or the Whole of their parts portions or purparties of the lands as are So Allotted to any of them by the partition and alottment afd that in Such Case no Contribution shall be had or pretended to be had either in Law or equity by the person or persons so evicted his or their heirs or assigns from any of the other parties their heirs Extors or Adm.rs but that such party evicted and the person or persons Claiming under him shall for ever by these presents be Debarred and precluded of & from any Remedy for the same by any way Whatsoever In Witness whereof to this Indenture with the s.d Charles Diggs & Susanna Maria his Wife remaining the s.d Henry Darnall & Elizabeth his Wife Edward |
