(127) x.d This Indenture Made the Fifteenth day of December Anno Domini Seventeen hundred and thirty two Between Charles Carroll of Annapolis Esquire Charles Carroll of Annapolis Chyrurgeon and John Digges of Prince Georges County Gentleman being the Major part of the Executors of the Testament and last Will of James Carroll late of Ann Arundell County Gentleman deceased of the one part and Richard Johns of Ann Arundell County Planter of the other part Whereas the said James Carroll by his Last Will and Testament in Writing duely Executed Inter alia in Impowered his Executors or the Major part of them to Dispose of all his Lands in Baltimore County and by that Testament appointed the said Charles Carroll Esquire Charles Carroll Chyrurgeon and John Digges parties to these presents to be his Executors together with Francis Hall Gentleman And Whereas the said James Carroll Died Seized in his Demesne as of Fee of a Tract or parcell of Land lying in Baltimore County aforesaid Called Rich Bottom with the Appurtenances thereunto belonging bound as followeth Beginning at two marked Red Oakes standing a Mile from the River Susquahannah one whereof marked I C then East fourteen perches to the End of the last line of Upper Stocketts thence bounding with the head line of the said Land North by West one hundred and two per.s to the Land called the Rich Levell thence with the said Land West three hundred & ninety perches thence south sixty perches thence East twenty nine degrees south Two hundred and seventy eight perches to the End of the fourth Course of Darnalls Convenience thence with the said Land East One hundred and seventy six perches thence bounding on the said Land still North forty five perches to Stocketts land aforesaid thence with a right line to the first trees containing Three hundred and eighty seven acres more or less Now this Indenture Witnesseth that the said Charles Carroll Charles Carroll and John Digges by virtue of the Power and Authority to them Given by the said James Carroll in and by his said Last Will And in Consideration of one hundred pounds sterling to them in Hand paid by the said Richard Johns the receipt whereof they hereby acknowledge and the said Richard Johns thereof and of every part and parcell thereof do Acquit Release and Discharge Have Bargained and Sold and by these Presents do Bargain and Sell unto the said Richard Johns the said Tract or parcel of Land Together with all Buildings Improvements Profits Commodities Advantages and Appurtenances thereunto belonging To have and to hold to him the said Richard Johns his Heirs and Assignes for ever to his and their own proper Use and to no other Use or Intent whatsoever And the said Charles Carroll Charles Carroll and John Digges for themselves and their Heires Covenant and Agree to and with the said Richard Johns his Heires and Assigns that they the said Charles Carroll Charles Carroll and John Digges and their the said Tract of Land and other the Premisses to the said Richard Johns his Heirs and Assigns (for) |
