(77) Hold the Lands and Premises af.d
unto him the said Charles Carroll his Ex.rs Adm.rs & assigns for and during the term of Forty years as af.d yeilding & paying yearly for the same to the said Richard Banks one grain of Judiah Corn in cae the same shall be Demanded yearly at or upon the first day of January af.d the said Charles at his Dwelling Place Provided Nevertheless that it is the true Intent and Meaning of this Lease that it being made only as Collaterall & Additionall security to a Conditionall Bill of Sale of sundry Negros Other Chattles bearing date herein for the security of the payment of two hundred & forty pounds three shillings Current Money with the legal Interest thereon to be yearly paid If the sum af.d of two hundred forty pounds three shillings Chir duly as af.d with the legal interest thereof shall be paid at or upon the sixth day of May 1726 that then this lease shall cease & be null & void to all intents and purposes Sealed & Delivered in the R.d Banks Seal presence of Tho Hughes Tho Clarke which Lease was Endorsed viz.t May the 6.th 1725 Then reced the five shillings consideration money with in mentioned by me the subscriber I have also reced full satisfaction for all the Rents reserved on this Lease Wittness my hand the day & year above written Test Thom.s Hughes R.d Banks Tho Clarke May the 6.th 1725 Then came before Me Samuel Young Esq.r his Lordships Chief Justice of the Provincial the within mentioned Richard Banks and acknowledged the within Deed to be his Act and Deed according to Act of Assembly in that case made & provided Recorded July 21.st 1725 Sam Young |
