(330) Thence by a Lyne Drawn West Forty perches then South
Eighty perches then East forty perches then with a straight Lyne to the first Tree Containing and laid out for twenty acres more or less according to the Certificate of Survey thereof taken and returned into the Land Office of the Said Charles Lord Baltemore bearing Date the fourteenth day of February One Thousand seven hundred twenty three and there remaining together with all Messuages and Buildings thereupon Erected or to be Erected and all rights profitts Benefits and Privilidges thereunto belonging (Royall mines Excepted) To have and to hold the same (Except before Excepted) unto him the said Darby Conner his heirs & assignes for ever To be holden of us the said Charles Lord Baltemore and our heirs as of our manner of Ann Arundell in free and Common Soccage by Fealty only for all manner of services Yeilding and paying therefore yearly unto us the said Charles Lord Baltemore and our heirs ^all^ our Receipt at the City of S.t Marys at the two Most usual Feasts in the year (viz.t) The Feast of S.t Mich.ll the ark angell & the Annunciation of the Blessed Virgin Mary by even and Equall portions the rent of nine pence half penny sterling in silver of Gold and for a fine upon every alienation of the said Land or any part or parcell thereof one whole years Rent in Silver or Gold or the full value thereof in such Comodities as we the said Charles Lord Baltemore and our heirs or such Officer or Officers shall be appointed by us & our heirs from time to time to Collect and receive the same shall accept in Discharge thereof at the Choise of us and our heirs or such Officer or Officers as aforesaid Provided that if the said sume for a fine for alienation shall not be paid to us and our heirs or such Officer or Officers aforesaid before such alienation Entred upon Record either in the provinciall Court or County Court where the same parcell of Land Lyeth within One month next after such alienation then the said alienation shall be void & of no Effect And they the said John Hyde & Charles Lowe for themselves severally and Respectively and not joyntly nor one for the other or for the Act Deed or Deeds of the other & (for) |
