100 Both or Either of them all and every
such sum and sums of money goods wares merchandizes effects Estate and things whatsoever due or to grow due owing belonging or in any wise appertaining to him the said constituant in his own proper right or to the Crown in particular And also to him the said appearer (as being their agent substitute and Agent deriving authority from thence and legally constituted in that behalf whether by Bond Note Bill Book Debt Account Consignment Contract Agreement Extent Decree Sentence Judgment Execution or for or by what other reason or means soever nothing excepted nor reserved And to that end with any person or persons whom it shall or may concern to account and to view settle and adjust all accounts and the ballance thereof to receive upon recoveries and receipts to give one or more acquittances or other sufficient discharges in due form of Law And Further the said constituant doth hereby authorize and impower his said Attorney in cases of the misconduct or misbehaviour of Edward Brocket the present commander of the Goodship or vessel called the Rappahanock Merch.t lately bound to Virginia or his successors as also of Peter Casey the super cargoe thereof to eject displace & remove each and every of them out of and from such their respective stations And to substitute and appoint such other proper person or persons in their or either of their stead and place as his said Attorney shall think fitt and to call them or either of them to account touching y.e trusts committed to their care & management and to give proper discharges as occasion may require and to transact & manage all affaires relating thereto in all respects w.th y.e like authority as if he y.e said appearer were personally present But in Case of Refusall or Delay by any person or persons Whome it shall or may concerne to make and render just and true account and payment Delivery possession and sattisfaction in the premisses him or them thereunto to compell by all Lawfull waies and meanes whatsoever also if need be to appear before all Lords Judges and Justices in any Court or Courts there to answer defend and reply in all matters and causes touching or concerning the premisses to doe say pursue implead seize sequester attach imprison and to condemne and out of prison again to deliver also to compound conclude and agree by arbitration or otherwise as his s.d attry shall |
