Gaithersburg                                     2329

I, Harold C. Morris, Mayor of the City of Gaithersburg, Maryland,
do hereby certify the foregoing is the true and correct Resolution No.
R-21-69 passed at a meeting of the Mayor and City Council held on
the 9th day of June, 1969.

Resolution No. R-40-69

A Resolution authorizing the annexation by the City of Gaithersburg
of approximately 6.12 acres of land located to the southwest of the
present corporate boundaries.

Whereas, the Mayor and City Council of the City of Gaithersburg
have received a written petition requesting the enlargement of the cor-
porate boundaries of the City of Gaithersburg, so as to include an area
encompassing approximately 6.12 acres of land located to the southwest of
the present corporate boundaries and adjacent thereto.

Whereas, the signatures of the said Petition of Consent have been
verified and it has been ascertained that the persons signing said Petition
are owners of not less than twenty-five percent (25%) of the assessed
valuation of the real property located in the area to be annexed and rep-
resent at least twenty-five percent (25%) of the persons who reside in the
area to be annexed and who are registered as voters in County elections.

Whereas, from the provisions of Section 19(b), of Article 23(a) of
the Annotated Code of Maryland, 1957 Edition, as amended, it is man-
datory that the following Resolution be introduced.

Section 1. BE IT RESOLVED, by the Mayor and City Council of the
City of Gaithersburg that a new section to the Charter of the City of
Gaithersburg be added. Said new section to be known as Section jj to
provide for the enlargement of the corporate boundaries of the City of
Gaithersburg by including the following area:

Parcels A and B, Quince Orchard Shopping Center, Gaithersburg
District, Montgomery County, Maryland;

Beginning for the same at a point on the Northeasterly side of the
Darnestown-Rockville Road, Maryland Route #28, the Southeast corner of
Parcel "B" Quince Orchard Shopping Center as shown on plat and filed
among the Land Records of Montgomery County, Maryland, in Plat Book
84, Plat No. 8719, thence along said road to include said parcel and also
all of parcel "A" Quince Orchard Shopping Center, as shown on plat filed
in Plat Book 80, Plat No. 8135, N. 67°23'W. 560.63 feet thence on a curve
to the left having a radius of 2351.83 feet for a distance of 105.00 feet,
thence N.15°45'10". 84.60 feet to a point on the Southeasterly side of
Quince Orchard Road, Maryland Route #124, thence along said road N.41°
18'45" E. 370.00 feet thence on a curve to the left having a radius of
1492.40 feet for a distance of 351.33 feet thence leaving said road and
bounding along the East line of Parcel "B" S.12°12'40"E. 922.65 feet to
the place of beginning. Containing 6.1180 acres of land.
