2328                               Municipal Charters

Whereas, from the provisions of Section 19(b), of Article 23(a)
of the Annotated Code of Maryland, 1957 Edition, as amended, it is
mandatory that the following Resolution be introduced:

Section 1. BE IT RESOLVED, by the Mayor and City Council of
the City of Gaithersburg that a new section to the Charter of the City of
Gaithersburg be added. Said new section to be known as Section ii to
provide for the enlargement of the corporate boundaries of the City of
Gaithersburg by including the following area:

Being the same land conveyed by George W. Plummer, widower, to
Reverend William G. Tyler, et ux, by deed dated March 15, 1949 and
recorded in Liber 1242 at Folio 578 among the Land Records of Mont-
gomery County, Maryland, and being more particularly described as fol-
lows:

Beginning for the same at the beginning of the 5th line of the afore-
said conveyance, said point being also the common corner of "Hyde Park"
and "Montgomery Village" and running thence with the outlines of said
conveyance with bearings referred to the Washington Suburban Sanitary
Commission meridian;

1.    N 54°36'24" W 1028.17' to the centerline of Old Watkins Mill
Road; thence with said centerline the following 2 courses and distances:

2.    S 40°53'36" W 250.87; thence

3.    170.41' along the arc of a curve to the left with a radius of
388.21; chord S 28°19'06" W-147.27; thence leaving said centerline

4.    S 54°36'24" E-1031.42'; thence

5.    N 35°23'36" E-417.50' to the place of beginning; containing
10.0003 acres of land.

Section 2. BE IT FURTHER RESOLVED, by the Mayor and City
Council of the City of Gaithersburg that the date of the introduction
of this Resolution is the 7th day of April, 1969, and shall become effective
forty-five (45) days following its adoption unless a prompt petition for
referendum thereon shall be filed as permitted by law, and provided
further that the notice as required by law shall be published in the
Gaithersburg Gazette, being a newspaper of general circulation in the
City of Gaithersburg, once each week in the weeks of April 7, 14, 21, and
28, 1969. Said notice to provide for a public hearing to be held on
May 19, 1969 at 8 p.m. in the Council Chambers of the Mayor and
City Council, 31 South Summit Avenue, Gaithersburg, Maryland.

Section 3. BE IT FURTHER RESOLVED, by the Mayor and City
Council of Gaithersburg, that as soon as this Resolution is adopted it
shall become effective either as herein provided, or the following of a
referendum, the City Administrator shall promptly register both the orig-
inal boundaries and the new boundary with the Clerk of the City or
similar official thereof, with the Director of the Hall of Records, with the
Clerk of the Circuit Court for Montgomery County, with the Director
of the Department of Legislative Reference, and with the Maryland State
Library.

Section 4. BE IT FURTHER RESOLVED, by the Mayor and City
Council of the City of Gaithersburg, that the persons residing therein,
if any, shall, after the effective date of this Resolution, be subject to
all the laws, ordinances and resolutions of the City of Gaithersburg,
Maryland.
