struction Fund," which is hereby established, a sum equal to such
amount of federal aid secondary highway funds that may become
available from the Bureau of Public Roads and that may be allo-
cated by the State Roads Commission to the several counties and
that may subsequently be released by such counties to the State
Roads Commission for use on the State highway system. Such
County Highway Construction Fund shall be subject to apportion-
ment by the State Roads Commission and matching construction
funds shall be required of each such county participating in such
program. Such County Highway Construction Fund and such match-
ing funds shall be expended only for highway construction and re-
construction projects under such rules and regulations as the Com-
mission shall determine.

[(d)] (b) Municipality as used herein means any incorporated
town, city or village within the State of Maryland entitled to re-
ceive federal-aid urban funds.

The term "urban area" as used herein means an area including
and adjacent to a municipality or other urban place having a popu-
lation of five thousand or more, as determined by the latest avail-
able federal census, within boundaries to be fixed by the State
Roads Commission.

[(e)] (c) The State Roads Commission, with the approval of
the municipality or urban area as the case may be, and with the
consent of the [Governor] Secretary of Transportation and under
the provisions of Section 8 of Article 15A may, in any fiscal year,
[transfer from the Construction Fund prescribed in this section]
allocated from the Transportation Trust Fund to a "Municipality-
Urban Area Highway Construction Fund," which is hereby estab-
lished, a sum equal to such amount of federal-aid urban highway
funds that may become available from the Bureau of Public Roads
and that may be allocated by the State Roads Commission to the
several municipalities and urban areas and that may subsequently
be released by such municipalities and urban areas to the State
Roads Commission for use on the State highway system. Such
Municipality-Urban Area Highway Construction Fund shall be sub-
ject to apportionment by the State Roads Commission and match-
ing construction funds shall be required of each such municipality
and urban area participating in such program. Such Municipality-
Urban Area Highway Construction Fund and such matching funds
shall be expended only for highway construction and reconstruc-
tion projects under such rules and regulations as the Commission
shall determine.

33.

The monies distributed to Baltimore City under the provisions
of Section 38A shall be used (1) for the construction, reconstruc-
tion or maintenance of the streets and highways of the City of
Baltimore, (2) to pay the costs of the Baltimore City police depart-
ment for carrying out traffic functions and enforcing the traffic
laws; (3) to pay the costs incurred in other highway related
activities of such City in lighting highways, providing for storm
water drainage of said highways, and providing for street clean-
ing not to include the cost of collection of garbage, trash and refuse;
and (4) for the payment of debt service with respect to bonds or
other evidences of debt heretofore or hereafter issued by the City
