persons is guilty of a misdemeanor, and upon conviction shall be
sentenced to pay a fine not exceeding one thousand ($1,000.00) dollars
FIVE HUNDRED ($500.00), or to undergo imprisonment not exceed-
ing one (1) year or both, at the discretion of the court.
IN BALTI-
MORE CITY, THE MUNICIPAL COURT AND CRIMINAL COURT
SHALL HAVE CONCURRENT JURISDICTION TO TRY PER-
SONS CHARGED WITH THIS OFFENSE.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1969.

CHAPTER 373
(House Bill 901)

AN ACT to repeal and re-enact, with amendments, Section 5 of Arti-
cle 16 of the Annotated Code of Maryland (1966 Replacement Vol-
ume), title "Chancery," subtitle "Alimony," providing that it
shall be within the sole discretion of the court as to the granting
of alimony pendente lite during an appeal when the decree of court
is silent or reserves alimony.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That Section 5 of Article 16 of the Annotated Code of Maryland
(1966 Replacement Volume), title "Chancery," subtitle "Alimony,"
be and it is hereby repealed and re-enacted, with amendments, to
read as follows:

5.

(a)    In all cases where alimony or alimony pendente lite and
counsel fees are claimed, the court shall not award such alimony or
counsel fees unless it shall appear from the evidence that the wife's
income is insufficient to care for her needs.

(b)    In all cases where a decree of the court is silent as to ali-
mony, or where a decree of the court reserves alimony, it shall be
within the sole discretion of the court that issued such decree as to
whether alimony pendente lite on appeal shall be granted.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1969.
