(5) The Court finds that the landlord has brought an action or
proceeding to recover possession or has increased the rent for good
cause and not in retaliation for the exercise of actions enumerated
under subsection (b) hereof.

(d) Waiver of Tenant's Rights Prohibited.

Any provision of a lease or other agreement whereby any provision
of this section for the benefit of a tenant, resident, or occupant of a
dwelling is waived, shall be deemed against public policy and shall
be void.

(E) APPLICATION TO HOUSING AUTHORITY OF BALTI-
MORE CITY.

THIS LAW AND SECTION 459A OF THE CODE OF THE
PUBLIC LOCAL LAWS OF BALTIMORE CITY SHALL APPLY
TO ANY PREMISES LEASED BY THE HOUSING AUTHORITY
OF BALTIMORE CITY.

Sec. 2. And be it further enacted, That all laws or parts of laws,
public general or public local, inconsistent with the provisions of
this Act, are hereby repealed to the extent of any such inconsistency.

Sec. 3. And be it further enacted, That this Act shall take effect
July 1, 1969.

CHAPTER 224
(Senate Bill 384)

AN ACT to add a new Section 300 (m) to Article 77 of the Annotated
Code of Maryland (1965 Replacement Volume and 1968 Supple-
ment), title "Public Education," subtitle "Chapter 31. Community
Colleges," to follow immediately after Section 300 (1) thereof,
amending the community college laws as they apply in Garrett
County in order to correct an inadvertent omission therein.

Whereas, by Chapter 554 of the Acts of 1967 the community col-
lege laws were amended by adding a special provision for Garrett
County requiring the holding of a referendum under certain circum-
stances; and

Whereas, by inadvertence these provisions were not included in
a subsequent amendment to this Section in Chapter 454 of the Acts
of 1968; and

Whereas, it is desirable to amend Section 300 of Article 77 to add
the Garrett County provisions and clarify any doubts about the pres-
ent status of the law in that county; now, therefore

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 300 (m) be and it is hereby added to Article 77
of the Annotated Code of Maryland (1965 Replacement Volume and
1968 Supplement), title "Public Education," subtitle "Chapter 31.
Community Colleges," to follow immediately after Section 300 (1)
thereof, and to read as follows:
