of passengers within the State and persons engaged in that busi-
ness; ,
but does not mean any such entity primarily rendering taxi-
cab or airport limousine service;

(g) "Public Service Commission" means the Public Service Com-
mission of the State of Maryland;

(h) "Transit facilities" means all real and personal property
necessary or useful in rendering transit service between points with-
in the District by means of rail, or bus, including without limita-
tion, tracks, rights-of-way, bridges, tunnels, subways, rolling stock
for rail, motor vehicle, or other modes of transportation, stations,
terminals and ports, areas for parking and all equipment, fixtures,
buildings and structures and services incidental to or required in
connection with the performance of transit service;

(i) "Transit service" means the transportation of persons and
their packages and baggage in regular route, special or charter serv-
ice by means of transit facilities between points within the District,
or in any county contiguous to the District as permitted in this
Article, and includes the transportation of newspapers, express and
mail between such points but does not include taxicab or airport
limousine service.

3. Creation of Metropolitan Transit District.

There is hereby created the Metropolitan Transit District, com-
prising the territory lying within the boundaries of the City of
Baltimore and the Counties of Baltimore and Anne Arundel.

4. Creation of Metropolitan Transit Authority.

There is hereby created the Metropolitan Transit Authority, a
body corporate and politic, as an instrumentality of the State, which
shall have the powers and duties granted in this Article, as amended
from time to time, and such additional powers as may hereafter
lawfully be conferred upon it pursuant to law, to manage, conduct
and control the functions, affairs and property of the corporation.

5. Board of Directors.

(a) Composition; appointment of members. The Authority shall
be governed by a Board of Directors consisting of seven voting
members and the Chairman of the State Roads Commission and the
Executive Director of the Regional Planning Council, who shall
serve ex-officio as non-voting members. Four members of the Author-
ity shall be appointed by the Governor of Maryland with the advice
and consent of the Senate. They shall be residents of the State of
Maryland and shall be persons of ability, experience and integrity,
and they shall not be selected as representing or supporting any
special interest or interests. At least one of the members shall reside
in Baltimore City, at least one in Anne Arundel County, and at least
one in Baltimore County. Of the three remaining voting members,
one shall be appointed by the Mayor of Baltimore City, one shall be
appointed by the County Executive of Anne Arundel County, and
one shall be appointed by the County,
