15 (c), 15 (d) of Article 49B of the Annotated Code of Maryland
(1968 Replacement Volume), AND TO ADD NEW SECTION 16
THERETO, title "Interracial Commission," subtitle "Enforcement
Powers of Commission," and to repeal Section 12A of Article 64A
of the Annotated Code of Maryland (1968 Replacement Volume),
title "Merit System"; to add three members at large to the Human
Relations Commission, to change the title of the executive secre-
tary, to authorize the Commission to recommend legislation, to
enable the Commission to initiate investigations, to provide for
the hearing of complaints, to change the method by which the
Commission institutes court proceedings, to establish investiga-
tive procedures and penalties for discrimination in State employ-
ment, TO ENLARGE COVERAGE OF THE COMMISSION, to
provide for a general counsel to the Commission, to require that
all information PERTAINING TO INVESTIGATION of the
Commission be confidential, with penalties provided for breach of
confidentiality, and relating generally to the elimination of dis-
crimination in the State of Maryland.
Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 1, 2, 3, (A), (B), 12, 13 (a), 14 (a), 15 (a), 15 (e) and
18 (b) of Article 49B of the Annotated Code of Maryland (1968 Re-
placement Volume, 1968 Supplement), title "Human Relations Com-
mission," subtitles "Commission on Human Relations," "Enforcement
Powers of Commission," and "Discrimination in Employment," be
and they are hereby repealed and re-enacted with amendments; and
that new Section 11B be and it is hereby added to Article 49B of said
Code to follow immediately after Section 11A thereof; and that Sec-
tion 12A of Article 64A of the Annotated Code of Maryland (1968
Replacement Volume), title "Merit System," and Sections 15 (b),
15 (c), 15 (d) of Article 49B of the Annotated Code of Maryland
(1968 Replacement Volume), title "Interracial Commission," subtitle
"Enforcement Powers of Commission," be and they are hereby re-
pealed, AND THAT NEW SECTION 16 BE ADDED TO SAID
ARTICLE 49B OF THE ANNOTATED CODE OF MARYLAND
(1968 REPLACEMENT VOLUME), TITLE "INTERRACIAL
COMMISSION," SUBTITLE "ENFORCEMENT POWERS OF
COMMISSION," all to read as follows:
1.
There is hereby created a Commission on Human Relations to
consist of ([nine] twelve members who shall be appointed by the
Governor for a term of six years, by and with the advice and consent
of the Senate. [Of the members first appointed, three shall be for a
term of two years, three for a term of four years and three for a
term of six years but thereafter, their successors shall be appointed
for terms of six years.] The Governor shall designate the chairman
of said Commission. In case of any vacancy, the Governor shall ap-
