Constitution]. The Commissioner of Health shall be responsible for
discharging the functions assigned by the [Board] Secretary of
Health and Mental Hygiene to the State Department of Health, and
for the administration of that Department.
The Commissioner of Health shall organize the Department of
Health as may be necessary to carry out the responsibilities and
functions of the Department. The Commissioner of Health shall have
such assistants, employees and professional consultants as may be
approved by the Secretary of Health and Mental Hygiene and pro-
vided in the budget. Deputy and Assistant Commissioners, as may
be provided for in the budget, shall be appointed by the Secretary,
with the advice of the Commissioner, and shall serve at the pleasure
of the Secretary.

The Governor shall, upon recommendation of the [Board,] Secre-
tary of Health and Mental Hygiene, appoint a Commissioner of the
State Department of Mental Hygiene, hereafter known as the Com-
missioner of Mental Hygiene, who shall be an experienced psychi-
atrist, skilled in the administration of mental hygiene, and who shall
be certified in psychiatry by the American Board of Psychiatry and
Neurology. [Dr. Isadore Tuerk shall become the Commissioner and
shall serve in that capacity as long as he performs his duties in a
competent manner.] The Commissioner of Mental Hygiene shall
receive such salary as may be provided in the budget, and he shall
continue in office until removed by the Governor upon the recom-
mendation of the Secretary of Health and Mental Hygiene [for
incompetency or misconduct, under the provisions of Section 15 of
Article II of the Constitution]. The Commissioner of Mental Hygiene
shall be responsible for discharging the functions assigned by the
[Board] Secretary of Health and Mental Hygiene to the State De-
partment of Mental Hygiene, and for the administration of that
Department.
The Commissioner of Mental Hygiene shall organize the Depart-

The Commissioner of Mental Hygiene shall appoint, with the
approval of the [Board] Secretary of Health and Mental Hygiene,
a deputy commissioner of mental hygiene, a superintendent of Spring
Grove State Hospital, Springfield State Hospital, the Eastern Shore
State Hospital, Crownsville State Hospital, Rosewood State Hospital,
the Clifton T. Perkins State Hospital, and Henryton State Hospital,
as well as any additional hospitals which may come within his
administrative jurisdiction.
